| dc.description.abstract | A separação judicial de duas pessoas que constituíam família dá origem à diversas problemáticas, incluindo de cunho pessoal, principalmente se o casal possuía filhos. Os conflitos resultantes não deveriam estender-se à prole, que, com frequência, torna-se objeto durante os procedimentos da separação. Em decorrência desses conflitos, é comum a prática da alienação parental, que consiste na manipulação dos filhos por parte de um genitor, com intenção de atacar e demonizar a imagem do outro genitor. Essa prática acarreta problemas psicológicos diversos à prole e também ao genitor atacado, de forma que a legislação se movimentou para coibi-la, através da promulgação da Lei n° 12.318/10 e, posteriormente, a Lei n. 13.431/2017, estipulando as medidas legais cabíveis quando se constata esse episódio no ambiente familiar. Isto posto, o presente trabalho visa o estudo da mitigação da alienação parental através do instituto da guarda compartilhada, analisando a legislação pertinente, posicionamentos doutrinários e decisões judiciais. | pt_BR |
| dc.description.abstract | The legal separation of two people who constituted a family gives rise to several problems, including personal ones, especially if the couple had children. The resulting conflicts should not extend to the offspring, who often become the object during separation proceedings. As a result of these conflicts, the practice of parental alienation is common, which consists of the manipulation of children by one parent, with the intention of attacking and demonizing the image of the other parent. This practice causes several psychological problems to the offspring and also to the attacked parent, so that the legislation moved to curb it, through the enactment of Law n° 12.318/10 and, later, Law n. 13,431/2017, stipulating the appropriate legal measures when this episode is found in the family environment. That said, the present work aims to study the mitigation of parental alienation through the institute of shared custody, analyzing the relevant legislation, doctrinal positions and judicial decisions. | pt_BR |
