dc.description.abstractO presente artigo foi realizado com o intuito de elucidar e demonstrar os impactos que a nova Lei Geral de Proteção de Dados (“LGPD”) trouxe no debate quanto ao Direito ao Esquecimento no Brasil. Desse modo, através desse projeto, busca-se discorrer sobre o quanto o novo Marco Civil da Internet pode exercer seu impacto no poder do indivíduo de exercer seu controle e regular as informações contidas na internet a seu respeito, e o quanto isso afeta uma discussão sobre direitos constitucionais que entram em conflito desde muito antes da LGPD. Por um lado, há o direito à honra e preservação à imagem individual, e, de outro, há a liberdade de imprensa e de acesso à informação. As referências bibliográficas a serem utilizadas para a realização do artigo será composta por livros, doutrinas, artigos, entrevistas e demais métodos informativos, bem como a legislação brasileira que abrange essa discussão.
dc.description.abstractThe present arcticle was carried out with the intention of elucidating and demonstrating the impacts that the new General Data Protection Law ("LGPD") has brought to the debate regarding the Right to be Forgotten in Brazil. Therefore, through this project, we seek to discuss how much the new Internet Civil Rights Framework can have an impact on the individual's power to exercise control and regulate information about themselves on the internet, and how this affects a discussion about constitutional rights that have been in conflict long before the LGPD. On the one hand, there is the right to honor and preservation of individual image, and on the other, there is freedom of the press and access to information. The bibliographical references to be used for the completion of the arcticle consist of books, doctrines, articles, interviews, and other informative methods, as well as Brazilian legislation that covers this discussion.
