dc.description.abstractO presente trabalho objetiva analisar a Arguição de Descumprimento de Preceitos Fundamentais nº 618, submetida pela então Procuradora-Geral da República, Raquel Dodge, ao Supremo Tribunal Federal que aduz lesão a preceitos fundamentais de ordem constitucional em decorrência da imposição que alguns dispositivos legais, resoluções do Conselho Federal de Medicina (CFM) e orientações do Código de Ética Médica fazem aos pacientes Testemunhas de Jeová para que sejam submetidos a intervenções médicas, em especial a terapia transfusional; desrepeitando o direito da autodeterminação desses pacientes em terem tratamentos compatibilizados com sua liberdade de consciência e crença. Para tanto, estruturou-se o texto em quatro partes. Na primeira, apresenta-se resumo da ADPF aludida, que busca tutelar o direito desta comunidade religiosa em assegurar que suas escolhas, baseadas em convicções religiosas, sejam reconhecidas e respeitadas quando do momento da escolha médica-terapêutica. Na segunda, são analisadas duas decisões de primeira instância que, divergentes, demonstram a insegurança jurídica do tema. Na terceira, são propostos dois Recursos Extraordinários que, apesar de ainda não decididos, apontam para dificuldades financeiro-técnicas para a implementação do direito de acesso a tratamentos alternativos. Na parte final, é feita a reflexão de qual deve ser o posicionamento do médico, com base na atual vigência das resoluções do CFM, do Código de Ética Médica e da Declaração de Genebra. Ao fim, conclui-se pela procedência da ação, pois trata-se de um desdobramento natural dos princípios exaustivamente tratados nesta exposição, qual seja, a dignidade da pessoa humana, inviolabilidade da vida, liberdade de consciência e crença.pt_BR
dc.description.abstractThe present work aims to analyze the Complaint of Breach of Fundamental Precept number 618, submitted by the Office of the Prosecutor General, Raquel Dodge, to the Federal Supreme Court that mentions injury to fundamentals precepts of constitutional order because of the imposition that some legal provisions, Federal Medical Council's resolutions (CFM), and Code of Medical Ethics' guidelines upon Jehovah's Witness patients to be submitted to medical intervention, especially with transfusion therapy; disrespecting the right of self-determination of those patients to compatible medical treatments with their freedom of conscience and belief. Therefore, the text was structured in four parts. In the first part a summary of the referenced ADPF is presented which attempts to protect the right of this religious community to ensure that their choices, based on religious convictions, are recognized and respected at the moment of the medical therapy' decision. In the second part, two decisions of the first instance are analyzed which, divergent, show a legal uncertainty of the subject. In the third part, two Extraordinary Appeals are presented that, although not yet decided, point to financial and technical difficulties in implementing the right of access to alternative treatment. In the final part, a reflection is made on what the physician's position should be, based on the current validity of CFM resolutions, the Code of Medical Ethics and the Geneva Declaration. In the end, it is concluded that the lawsuit is accepted, because it is a natural unfolding of the principles exhaustively applied in this exhibition, namely, the dignity of the human person, inviolability of life, freedom of conscience and belief.pt_BR
