dc.description.abstractO presente trabalho tem por objetivo apresentar a relevância dos aspectos jurídicos da guarda compartilhada de animais em face do direto de família. Nesse sentido, buscou-se estabelecer a relação contextual da modificação do núcleo familiar bem como dos aspectos jurídicos do instituto da guarda e suas modalidades, quando da ruptura do relacionamento do casal, além de levar em consideração o conceito contemporâneo de família, que atualmente se apresenta de maneira mais democrática. Mas de modo especial, procurou-se demonstrar a fragilidade desses animais, frente às lacunas existentes no ordenamento jurídico quanto à regulamentação de sua guarda, possibilidade de concessão de pensão alimentícia, bem como de sua natureza jurídica.pt_BR
dc.description.abstractThe present work aims to present the relevance of the legal aspects of shared custody of animals in the face of family law. In this sense, we sought to establish the contextual relationship of the modification of the family nucleus as well as the legal aspects of the guard institute and its modalities, when the couple's relationship broke out, besides taking into account the contemporary concept of family, which currently presents itself in a more democratic way. But in a special way, we tried to demonstrate the fragility of these animals, given the gaps in the legal system regarding the regulation of their custody, the possibility of granting alimony, as well as their legal nature.pt_BR
