Resumo
Este presente artigo versa sobre a abordagem da constelação familiar sistêmica
desenvolvida por Bert Hellinger perante o Poder Judiciário pátrio, como meio alternativo de
resolução de conflitos, tendo sido o trabalho elaborado majoritariamente por meio de pesquisa
virtual, principalmente pela análise de vídeos disponibilizados na internet e resultados de
pesquisas forenses realizadas. Atualmente, os métodos alternativos no direito brasileiro, tal
como a mediação e a conciliação, fomentados pelo novo Código de Processo Civil, por
resoluções do Conselho Nacional de Justiça e ungidos por legislações específicas, vem
apresentando resultados positivos quanto à solução consensual de conflitos, porém limitados
quanto a seus efeitos no litígio e as ordens superiores que regem as relações humanas. Decisões
em um procedimento formal não satisfazem necessariamente aos verdadeiros anseios das
partes, apenas encerram o processo, tornando-se fundamental essa intervenção interdisciplinar
da técnica sistêmica, no sentido de solucionar conflitos de forma mais profunda e eficaz.
Resultados obtidos e publicados por Sami Storch, pioneiro no Brasil na introdução dessa
abordagem da constelação familiar sistêmica, revelam uma melhora significativa nas relações
entre as partes ao serem introduzidas na esfera jurídica, levando consequentemente a um
aumento do número de acordos em audiências, que trazem paz às relações. Dessa forma, este
estudo pretende explorar a psicoterapia da constelação familiar sistêmica como método
alternativo diferenciado ao Poder Judiciário pátrio e demonstrar a aplicação do direito sistêmico
como um potencial relevante e efetivo de conflitos no Judiciário, tendo em vista resultados
obtidos por profissionais da Justiça.
This article deals with the approach of the systemic family constellation developed by Bert Hellinger towards the judiciary, as an alternative means of conflict resolution, most of the work was done through virtual research, mainly through the analysis of videos made available on the Internet and results of forensic research carried out. Currently, alternative methods in Brazilian law, such as mediation and conciliation, fostered by the new Code of Civil Procedure, resolutions of the National Council of Justice and anointed by specific laws, has been showing positive results regarding consensual conflict resolution, however limited in their effects on the dispute and the higher orders governing human relations. Decisions in a formal proceeding don’t necessarily satisfy the true wishes of the parties, but only terminate the process, making this interdisciplinary intervention of systemic technique essential in order to resolve conflicts more deeply and effectively. Results obtained and published by Sami Storch, pioneer in Brazil in the introduction of this systemic family constellation approach, reveal a significant improvement in the relationship between the parties when introduced into the legal sphere, leading to an increase in the number of agreements in hearings, which bring peace to relations. Thus, this study aims to explore the psychotherapy of the systemic family constellation as a differentiated alternative method to the homeland judiciary and to demonstrate the application of systemic law as a relevant and effective potential of conflicts in the judiciary, considering the results obtained by legal professionals.
