O populismo penal é uma realidade cada vez mais evidente na sociedade contemporânea,
tratando-se de um viés fortemente fomentado pela ação midiática apelativa, que
espetaculariza a criminalidade com o objetivo de ter mais audiência e lucratividade e, como
resultado, fomentando a opinião pública, de tal maneira que a população passa a se sentir
desprotegida pelas leis penais, acreditando que tal fato resulta da impunidade. Assim, não são
raros casos nos quais os réus foram julgados e condenados pela sociedade antes mesmo de
passar pelo devido processo penal. Com isso, a lei penal acaba sofrendo influências do
expansionismo penal, que tem sua concretização com o objetivo de atender os anseios da
massa, enquanto deveria ser aplicado unicamente para proteger os bens jurídicos essenciais.
Portanto, esse estudo demonstrou a ligação intrínseca existente entre o populismo e o
expansionismo penal, utilizando dois casos que refletem fortemente tais situações, que foram
os assassinatos de Isabella Nardoni e de Daniella Perez. De maneira geral, conclui-se que a
comoção da população age como fomentadora por leis mais punitivistas e imediatistas,
porém, a falta de eficiência de tais ações é evidenciada pela criminalidade que só cresce no
país.
Criminal populism is an increasingly evident reality in contemporary society, being a bias strongly encouraged by appealing media action, which spectacularizes crime with the aim of having more audience and profitability and, as a result, fostering public opinion, in such a way that the population begins to feel unprotected by criminal laws, believing that this is the result of impunity. Thus, cases in which defendants were judged and condemned by society even before going through due criminal process are not rare. As a result, criminal law ends up being influenced by criminal expansionism, which is implemented with the aim of meeting the desires of the masses, while it should be applied solely to protect essential legal assets. Therefore, this study demonstrated the intrinsic link between populism and penal expansionism, using two cases that strongly reflect such situations, which were the murders of Isabella Nardoni and Daniella Perez. In general, it is concluded that the population's commotion acts as a promoter of more punitive and immediate laws, however, the lack of efficiency of such actions is evidenced by the crime that is only growing in the country.
