O Pacote Anticrime (conjunto de alterações na legislação brasileira) foi apresentado tendo
como principal causa de elaboração a luta contra a corrupção. Assim, no final de 2019 foi
sancionada a Lei nº 13.964, derivada desse pacote, alterando diversos dispositivos legais,
principalmente referente ao âmbito penal (direito penal). Dessa forma, foi alterada a redação da
alínea “e” do artigo 492, inciso I do Código do Processo Penal, acrescentando a possibilidade
de execução provisória da pena privativa de liberdade igual ou superior a 15 anos no Tribunal
do Júri. Esse tema é de suma importância na esfera jurídica, não apenas por conter um debate
atual com divergências doutrinárias e jurisprudenciais acerca de sua constitucionalidade
(decorrente do conflito sobre qual princípio deve prevalecer, a presunção de inocência ou a
soberania dos veredictos), mas por trazer mudanças significativas no âmbito penal. Pois, hoje,
em se tratando de decisão condenatória pelo Tribunal do Júri, quando cumprida os requisitos
de pena a cima mencionados, o Juiz deverá determinar o recolhimento do condenado à prisão,
mesmo não havendo o trânsito em julgado, assim podendo estar o caso pendente de recurso.
Com isso, a presente monografia busca esclarecer qual a função do Tribunal do Júri no Brasil,
mapeando os princípios que regem esse instituto e identificando de que forma o Pacote
Anticrime trouxe mudanças significativas no âmbito penal, principalmente no Tribunal do Júri
referente a execução provisória da pena. Como também, busca verificar se essa alteração é
eficaz, analisando se há uma inconstitucionalidade nesse dispositivo demostrando possíveis
princípios violados com essa alteração e como os doutrinadores se posicionam a respeito.
The Anticrime Package (set of amendments to Brazilian legislation) was presented with the fight against corruption as the main cause of elaboration. Thus, at the end of 2019, Law nº 13.964, derived from this package, was sanctioned, changing several legal provisions, mainly regarding the criminal scope (criminal law). In this way, the wording of item “e” of article 492, item I of the Code of Criminal Procedure was changed, adding the possibility of provisional execution of the custodial sentence of 15 years or more at the Jury Court. This theme is of paramount importance in the legal sphere, not only because it contains a current debate with doctrinal and jurisprudential differences regarding its constitutionality (due to the conflict over which principle should prevail, the presumption of innocence or the sovereignty of the verdicts), but because it brings significant changes in the penal sphere. For, at present in the case of a condemnatory decision by the Jury Court, when the aforementioned penalty requirements are fulfilled, the Judge must determine the condemned person's imprisonment, even if there is no final judgment, so the case may be pending appeal. With this, the present monograph seeks to clarify the role of the Jury Court in Brazil, mapping the principles that govern this institute and identifying how the Anticrime Package brought significant changes in the criminal sphere, mainly in the Jury Court regarding the provisional execution of the sentence. It also seeks to verify if this change is effective, analyzing if there is an unconstitutionality in this law device, showing possible principles violated with this change and how scholars are positioned about it.
