Abstract
A presente monografia apresenta como objeto do estudo do planejamento sucessório no âmbito do direito internacional e os obstáculos enfrentados nas divisões e transmissões de bens localizados em território estrangeiro. Composta de três capítulos, objetivou-se a exposição com o método histórico analítico, para atingir o objetivo principal consistente em selecionar instrumentos que facilite e agilizem o processo da transmissão dos patrimônios, sejam móveis, imóveis, ações ou quotas, do de cujus, prezando sempre distanciar-se de litígios e conflitos familiares. Na primeira parte, foi feito um detalhamento histórico sobre o direito sucessório, culminando as influências pelas normas que vigorar no Brasil colônia até a atualidade e a aplicabilidade destas, destacando, ainda, as sucessões introduzidas pela Constituição Federal de 1988. Na segunda parte, abordou-se o planejamento sucessório, tratando sobre sua definição, importância e criação de modo a se adequar as mudanças da sociedade e sua influência na maneira de obtenção de bens, versando também sobre os principais instrumentos sucessórios, que podem vir a ser utilizados em casos de sucessões que envolvam o direito privado internacional. Na terceira parte da presente monografia demonstra, com base em questões reflexivas, os elementos das sucessões que lidam com bens em território estrangeiro, brasileiros domiciliados em outros países que tendem a herdar bens em território nacional, ou outras situações que envolvam questões internacionais, assim, é elaborado uma discussão acerta das leis aplicáveis, da competência de jurisdição e da aceitação de pluralidade de juízos. O estudo do planejamento sucessórios, com envolvimento do direito internacional privado, é considerado recente se comparado com outros campos do direito, por crescer e ganhar progressivamente mais atenção, na medida que a sociedade se desenvolve e a globalização aumenta com o desenvolvimento da tecnologia.
The present monograph presents as object of study the succession planning in the scope of international law and the obstacles faced in the divisions and dependency of assets located in foreign territory. Comprising three chapters, the objective was to expose the historical analytical method, to achieve the main objective consisting of selecting instruments that facilitate and speed up the process of transferring assets, whether movable, immovable, shares, or quotas, of the deceased, valuing always distance yourself from family processes and conflicts. In the first part, a historical detail was made on inheritance law, culminating in influences by the norms that are in force in Colonial Brazil until the present day and their applicability, also highlighting the successions fulfilled by the Federal Constitution of 1988. In the second part, it addressed - succession planning, dealing with its definition, importance, and creation in order to adapt to changes in society and its influence on the way of obtaining assets, also dealing with the main succession instruments, which may be used in cases of successions involving private international law. In the third part of this monograph it demonstrates, based on reflective questions, the elements of successions that deal with assets in foreign territory, Brazilians domiciled in other countries who tend to inherit assets in national territory, or other situations that involve international issues, thus, A discussion of pending laws, jurisdictional competence, and the acceptance of plurality of judgments is elaborated. The study of succession planning, involving private international law, is considered recent compared to other fields of law, as it grows and gains more attention as society develops and globalization increases with the development of technology.
