dc.description.abstractCom a evolução da Inteligência Artificial (IA), foi possível a criação de veículos autônomos com a finalidade de trafegarem pelas vias sem a necessidade de um condutor no comando, sendo este considerado pelas grandes empresas, como a Google, Apple e Tesla, uma solução viável para uma série de problemas relacionados à mobilidade das grandes cidades, como acidentes de trânsito, congestionamentos, contribuição à poluição, entre outros. Neste cenário, mediante a ingressão destes veículos no mercado, surgem vários questionamentos sobre possíveis problemas que podem ser causados no âmbito penal, ambiental, administrativo, civil e consumerista. Assim, seria correto afirmar que há autonomia na inteligência artificial, sendo a máquina capaz de tomar decisões e, portanto, podendo ser responsável por elas? Em caso de colisão entre estes veículos, de quem será a responsabilidade de sanar danos causados? Ainda, caso o incidente ocasione na morte de alguém, quem deverá responder pelo delito, o dono do veículo, o fornecedor, o fabricante? Assim, a partir de pesquisa bibliográfica e documental, iniciando-se de uma metodologia de abordagem quantitativa e, posteriormente, qualitativa, o presente artigo busca aprofundar-se sobre as possíveis hipóteses da responsabilidade civil objetiva do fornecedor do veículo autônomo, com enfoque no defeito do produto e serviço, sob uma análise da smart mobility.pt_BR
dc.description.abstractSince the beginning of computers era, the man dreams on create a mechanical or a technological brain. With that thought in mind the era of Artificial Intelligence (AI) started, with its evolution was possible to create autonomous self-propelled vehicles with the purpose of traveling on roads without the need for a driver in charge, something that is considered by large companies, such as Google, Apple and Tesla, an easy and possible solution for a series of problems related to mobility in large cities, such as traffic accidents, traffic jams, contribution to pollution, among others. In this scenario, upon the entry of these vehicles into the market, several questions emerged about possible problems that can be caused in the criminal, environmental, administrative, civil and consumer spheres. So, would it be correct to affirm the autonomy of artificial intelligence when making decisions, with the machine being able to be responsible for them? In the event of a collision between these vehicles, whose responsibility will it be to remedy the damage caused? Still, if the incident causes the death of someone, who should answer for the crime, the owner of the vehicle, the supplier, the manufacturer? Thus, based on bibliographical and documental research, starting with a quantitative and, later, qualitative approach methodology, this article seeks to dive in into the possible hypotheses of civil liability of autonomous vehicle manufacturers under an analysis of smart mobility.pt_BR
