Infiltração de agentes e sua compatibilização com as garantias constitucionais, sob a égide do princípio da proporcionalidade

Tendo em vista o avanço da criminalidade organizada no Brasil e no mundo, pesquisa-se sobre
a infiltração de agentes, a fim de verificar a possibilidade de uso deste instituto no combate ao
crime organizado. Para tanto, é necessário verificar a eficácia deste meio especial de obtenção
de provas no combate à criminalidade organizada; averiguar se a medida é restritiva de direitos
e garantias fundamentais; e, por fim, se é possível compatibilizar a infiltração de agentes com
as garantias e direitos constitucionais, através do princípio da proporcionalidade. Realiza-se,
então, uma pesquisa bibliográfica de diversos livros jurídicos, em especial aqueles relacionados
ao crime organizado e ao princípio da proporcionalidade, além de artigos acadêmicos de Direito
e da internet. Através deste referencial bibliográfico, aponta-se o conceito de crime organizado,
infiltração de agentes, agente infiltrado e agente provocador. Demonstram-se, ainda, os
principais aspectos procedimentais da infiltração e suas fases. Ressaltou-se também alguns
pontos de crítica por parte da doutrina quanto ao instituto e as possíveis soluções para tais. O
trabalho é finalizado com o conceito do princípio da proporcionalidade e a sua importância para
o uso do instituto da infiltração. Diante disso, verifica-se que o uso da infiltração é um meio
eficaz na obtenção de provas e no combate ao crime organizado e que a medida é realmente
restritiva de direitos fundamentais. O que leva à constatação de que é possível utilizar o instituto
em compatibilidade com os direitos e garantias constitucionais, desde que adotado o princípio
da proporcionalidade, através da razoabilidade, adequação e proporcionalidade em sentido
estrito.
Considering the advance of organized crime in Brazil and the world, a research on agent infiltration is made in order to verify the possibility of its use in the fight against organized crime. To that end, it is necessary to verify the effectiveness of this special mean of collecting evidence in the combat against organized crime; to investigate if this measure restricts fundamental rights and guarantees, and lastly, if it is possible to reconcilie agent infiltration with constitutional guarantees and rights through the Principle of Proportionality. In this sense, a bibliographical research is made through many legal books, notably those related to organized crime and the principle of proportionality, in addition to Law academic articles and articles from the internet. Through this bibliographic reference, the concept of organized crime, agent infiltration, infiltrated agent and agent provocateur was pinpointed. Also exposed were the main procedural aspects of infiltration and its stages. In addition, some points of criticism by specialist scholars concerning the institute were highlighted, as well as possible solutions. The research is wrapped up with the concept of the principle of proportionality and its importance to the use of the infiltration institute. In view of the above, it is possible to assess that infiltration is an effective mean of evidence collection and fighting organized crime, and that this measure actually restricts fundamental rights. In that sense, it demands the implication that it is possible to reconcilie the use of this institute with constitutional rights and guarantees, provided the principle of proportionality is used, through reasonability, adequacy and proportionality in the strict sense.
