dc.description.abstractO presente artigo tem como objetivo estudar a tese da multiparentalidade acolhida pelo Supremo Tribunal Federal, que reconheceu a possibilidade da coexistência das filiações biológica e socioafetiva em um mesmo registro, bem como os efeitos trazidos pelo reconhecimento da referida constituição familiar no Direito Brasileiro, no que se refere ao direito sucessório dos ascendentes. Através de pesquisa jurisprudencial e doutrinária, verificouse que o Direito Brasileiro tem evoluído rapidamente no que se refere às famílias, abrangendo outras formas de composição familiar além daquela formada por um pai e uma mãe, por exemplo, a multiparentalidade. No entanto, foi possível analisar que o Código Civil vigente não está apto a proteger os direitos de todas as formas familiares. Nesse contexto, buscou-se verificar qual a melhor maneira de se manter a isonomia entre as partes em caso de multiparentalidade, tendo em vista que o Código Civil, em seu artigo 1.836, § 2º, define que metade da herança caberá aos ascendentes da linha paterna, enquanto a outra metade caberá aos da linha materna. Tal isonomia também é discutida em relação ao artigo 1.837, que estabelece que a concorrência de ascendente com o cônjuge. Assim, o presente estudo buscou analisar as alternativas que podem ser adotadas a fim de preencher as lacunas da legislação brasileira no que se refere à multiparentalidade e aos Direitos Sucessórios.pt_BR
dc.description.abstractThis article aims to study the thesis of multiparentality fixed by the Federal Supreme Court, which recognized the possibility of the coexistence of biological and socio-affective affiliations in the same register, as well as the effects brought about by the recognition of this family constitution in Brazilian Law about the succession right of the ascendants. Through jurisprudential and doctrinal research, it was found that Brazilian Law has evolved rapidly regarding families, covering other forms of family composition in addition to that formed by a father and a mother, such as multiparenthood. However, it was possible to analyze that the current Civil Code is not able to protect the rights of all family forms. In this context, we sought to verify the best way to maintain equality between the parties in the case of multiparenthood, given that the Civil Code, in its article 1.836, § 2, defines that half of the inheritance will fall to the ascendants of the line paternal line, while the other half will belong to the maternal line. Such isonomy is also discussed in relation to article 1837, which establishes that the ascendant competes with the spouse. Thus, the present study sought to analyze the alternatives that can be adopted to fill the gaps in Brazilian legislation regarding multiparenthood and Succession Rights.pt_BR
