O presente trabalho tem como escopo analisar a intervenção do Poder Judiciário sobre os
atos administrativos, típicos do Poder Executivo, identificando os limites dessa intervenção, sob
a perspectiva do Estado Democrático de Direito brasileiro.Para tanto, percorremos a evolução
histórica do Estado, analisando seus desdobramentos ao longo do tempo, que culminaram
no atual Estado Democrático de Direito. Dessa análise, constatamos a relevante contribuição
do constitucionalismo moderno e suas fases para nossa atual compreensão de Constituição,
bem como de limitação do poder estatal. Feitas essas considerações iniciais, examinamos a
definição, elementos, classificações e demais características dos atos da Administração e dos
atos administrativos, com o intuito de estabelecer o alcance da intervenção do Estado Juiz no
Estado Administrador. No cerne do presente trabalho, apresentamos algumas das principais
normas, ao nível constitucional e infraconstitucional, que legitimam o controle jurisdicional
dos atos administrativos. A partir desse conjunto de princípios e regras, os quais formam o
sistema normativo de controle da atuação da Administração Pública, podemos afirmar que os
atos administrativos podem ser controlados pelo Poder Judiciário, quando este for provocado
a intervir numa situação de violação de direitos. Por fim, apresentamos os possíveis limites
para a intervenção do Poder Judiciário nos atos administrativos, segundo as perspectivas da
doutrina e da jurisprudência, o que nos leva à conclusão de que o controle jurisdicional dos atos
administrativos é cabível e necessário, mas inevitavelmente limitado, sob pena de afronta ao
princípio fundamental da separação dos poderes.
The present work aims to analyze the intervention of the Judiciary on administrative acts, typical of the Executive, identifying the limits of this intervention, from the perspective of the Brazilian Democratic State of law. To do so, we go through the historical evolution of the state, analyzing its development over time, which culminated in the current Democratic State of Law. From this analysis, we note the relevant contribution of modern constitutionalism and its phases to our current understanding of the Constitution, as well as the limitation of state power. After these initial considerations, we examine the definition, elements, classifications, and other characteristics of the acts of the administrative acts, to establish the extent of the intervention of the Judiciary in the Executive. At the heart of this paper, we present some of the main constitutional and infra-constitutional rules that legitimize the judicial control of administrative acts. From this set of principles and rules, which form the normative system to control the performance of the Public Administration, we can say that administrative acts can be controlled by the Judiciary when it is induced to intervene in a situation of violation of rights. Finally, we present the possible limits to the intervention of the Judiciary in administrative acts, according to the perspectives of doctrine and jurisprudence, which leads us to the conclusion that judicial control of administrative acts is appropriate and necessary, but inevitably limited, under an affront to the fundamental principle of separation of powers.
