A prescrição intercorrente surgiu no Código de Processo Civil com o intuito de evitar a eternização das demandas judiciais, garantindo os princípios constitucionais da razoável duração do processo, segurança jurídica e auxiliando o judiciário brasileiro na conquista de um sistema que preza pela celeridade processual. Em razão disso, pesquisa-se sobre esse instituto, a fim de analisar se seus propósitos estão sendo devidamente aplicados de forma efetiva na realidade, tal como se a inserção da prescrição intercorrente na legislação processual civil trouxe mudanças positivas às relações processuais. Para tanto, é necessário analisar a aplicação da prescrição como instituto limitador do fator temporal nas relações jurídicas, verificando seus aspectos históricos, suas principais características e sua aplicação nas fases de conhecimento e execução. Necessário também, a pesquisa acerca da definição de prescrição intercorrente, de seus propósitos, de sua origem na legislação brasileira e no Código de Processo Civil, e de seu emprego no processo de execução civil, especialmente no caso de sua ocorrência em virtude da suspensão da execução por ausência de bens penhoráveis. Diante disso, verifica-se a partir de um estudo comparativo entre as regras da prescrição intercorrente anteriormente e posterirormente à vigência do Novo Código de Processo Civil, bem como de um estudo a respeito da influência da morosidade do judiciário no decurso do prazo prescricional, que mesmo com as inovações legais trazidas, ainda restam importantes questões a serem abordadas para a efetivação da aplicação do instituto, principalmente no que concerne a proteção do credor que não se mantém inerte ao longo do processo e não dispõe dos meios necessários para garantir a efetivação do seu direito no processo de execução, no caso da suspensão da execução por ausência de bens passíveis de penhora por parte do devedor.
The intercurrent prescription came up in the Code of Civil Procedure in order to avoid the eternalization of judicial demands, guaranteeing constitutional principles of the reasonable duration of the process, legal certainty and helping the Brazilian judiciary to achieve a system that values procedural speed. As a result, research is being done on this institute, in order to analyze whether its purposes are being properly and effectively applied, such as whether the insertion of intercurrent prescription in civil procedural legislation has brought positive changes to procedural relations. Therefore, it is necessary to analyze the application of the prescription as a limiting institute of the time factor in legal relations, verifying its historical aspects, its main characteristics and its application in the discovery and execution phases. Also necessary, research on the definition of intercurrent prescription, its purposes, its origin in Brazilian legislation and the Civil Procedure Code, and its use in the civil enforcement process, especially in the case of its occurrence due to the suspension of execution for lack of assets subject to pawn. With that being said, it is verified from a comparative study between the rules of the intercurrent prescription before and after the validity of the New Code of Civil Procedure, as well as from a study about the influence of the slowness of the judiciary during the statute of limitations, which even with the legal innovations brought, there are still important issues to be addressed for the effective implementation of the institute, especially with regard to the protection of the creditor who does not remain inert throughout the process and does not have the necessary means to guarantee the effectiveness of the their right in the enforcement proceedings, in the case of suspension of enforcement due to the lack of assets from the debtor that could be pawned.
