dc.description.abstractO presente estudo tem por finalidade a análise da concessão de financiamento às empresas em recuperação judicial por meio do mercado de capitais. O problema é tratado a partir de uma abordagem exploratória, mediante pesquisa bibliográfica e estudo de caso, destacando brevemente a crise de empresa e as dificuldades para captação de recursos financeiros. Em seguida, inicia-se a discussão das formas de financiamento empresarial, com destaque para a emissão de títulos de dívida e a securitização de recebíveis, visando a preservação da empresa. Apresentado o tema central do trabalho, evidencia-se a necessidade de dar andamento ao Projeto de Lei nº 10.220/2018, com o intuito de resolver as lacunas presentes na lei falimentar vigente, sem prejuízo do desenvolvimento do mercado de capitais e das precauções que devem ser tomadas pelos envolvidos, a fim de garantir transparência e segurança ao procedimento.pt_BR
dc.description.abstractThe present study aims to analyze the granting of financing to companies in judicial recovery through the capital market. The problem is treated from an exploratory approach, through bibliographic research and case study, briefly highlighting the company crisis and the difficulties in raising financial funds. Next, the discussion of the forms of business financing begins, with emphasis on the issuance of debt securities and the securitization of receivables, aiming at the preservation of the company. After the presentation of the main theme of the work, it is evidenced the need to give progress to Bill no. 10.220/2018, in order to solve the gaps in the current bankruptcy law, without prejudice to the development of the capital market and the precautions that should be taken by those involved in order to ensure transparency and security to the procedure.pt_BR
