Abstract
O presente artigo tem por objeto o estudo das consequências para as empresas autoras
de crimes empresariais. O assunto ganhou sua relevância nas discussões jurídicas nos últimos
anos por colocar em teste o estudo da culpabilidade e das sanções impostas à pessoa jurídica,
incitando o Direito Penal a se especializar em uma nova modalidade chamada de Direito Penal
Econômico. Com delitos estruturados de forma moderna e com um modelo único de agente
delitivo, os penalistas precisaram desenvolver normas específicas além da Parte Geral do
código, de forma a conseguir suprir essa nova necessidade, que cada vez mais se expande no
mundo globalizado e com a tecnologia. Além disso, o artigo busca tratar da preocupação com
a manutenção da integridade e da concorrência saudável das empresas ao longo dos anos e da
função do compliance como mecanismo de prevenção aos delitos empresariais.
The aim of this paper is to study the consequences for companies that commit corporate criminal crimes. The subject has gained relevance in legal discussions in recent years by putting to the test the study of culpability and sanctions imposed on legal entities, encouraging Criminal Law to specialize in a new modality called Economic Criminal Law. With crimes structured in a modern way and with a single model of criminal agent, criminalists have had to develop specific laws in addition to the General Part of the code, in order to meet this new need, which is increasingly expanding in the globalized world and with technology. In addition, the article seeks to address the concern with maintaining the integrity and healthy competition of companies over the years and the role of compliance as a mechanism for preventing corporate crime.
