Abstract
O trabalho busca apresentar um conteúdo relevante das teorias da pena, trazendo uma evolução histórias das principais teorias e expondo o seu principal objetivo na sociedade. Tendo como fundamento as teorias das penas. Trazendo seus objetivos sendo difundidos nas aplicações das penas e no livramento condicional. Com base em doutrinas e códigos vigentes, buscou-se colher e expor o máximo informações importante para o leito conhecer as peculiaridades da pena e sua aplicabilidade. Com essas pesquisas pode-se concluir a ineficácia da pena privativa de liberdade e a frus-tação de um sistema carcerário precário fundada no critério punitivo.

With these researches, one can conclude the inef-fectiveness of the custodial sentence and the frustration of a precarious prison system based on the punitive criterion.
