dc.description.abstractO presente artigo tem por objetivo principal analisar se há previsão de direitos e garantias suficientes na legislação brasileira para assegurar a dignidade de mulheres transexuais e travestis no sistema prisional brasileiro. Inicialmente, verifica-se os principais aspectos sobre as questões de gênero, incluindo os conceitos de sexo, gênero, identidade e expressão de gênero e orientação sexual. São apresentados conceitos importantes relacionados à Criminologia Queer. Em seguida, é feita uma análise a respeito das mulheres transexuais e travestis na sociedade, entendendo a realidade preconceituosa e a exclusão social que enfrentam por desviarem-se do padrão heteronormativo. Ainda, é feita uma breve análise a respeito da situação do sistema prisional brasileiro, focando principalmente em como se dá o encarceramento das mulheres transexuais e travestis. Por último, são apresentadas as demandas e os direitos assegurados à população de mulheres transexuais e travestis encarceradas.pt_BR
dc.description.abstractThe main objective of this article is to analyze whether there are sufficient rights and guarantees in Brazilian legislation to ensure the dignity of transsexual and transvestite women in the brazilian prison system. Initially, the main aspects about gender issues are verified, including the concepts of sex, gender, gender identity and expression and sexual orientation. Important concepts related to Queer Criminology are presented. Then, an analysis is made about transsexual and transvestite women in society, understanding the prejudiced reality and social exclusion they face for deviating from the heteronormative pattern. Still, a brief analysis is made regarding the situation of the Brazilian prison system, focusing mainly on how the incarceration of transsexual and transvestite women takes place. Finally, the demands and rights ensured to the population of incarcerated transsexual and transvestite women are presented.pt_BR
