dc.description.abstractO presente trabalho teve como objetivo analisar o conflito relativo à natureza taxativa do Rol de Procedimentos e Eventos em Saúde Suplementar da Agência Nacional de Saúde Suplementar. Buscou-se analisar o sistema de saúde suplementar brasileiro e os aspectos econômico-financeiros e sociais envolvidos na temática, a fim de identificar consequência fáticas decorrentes da decisão da natureza do Rol da ANS. Analisou-se o julgamento do Recurso Especial n° 1.886.929 pelo Superior Tribunal de Justiça a fim os identificar os argumentos e fundamentações levantadas pela Corte que levaram ao entendimento pela chamada taxatividade mitigada. Além disso, procurou-se compreender os impactos da superveniente Lei n° 14.454/2022, que determinou a natureza exemplificativa do Rol. Com isso, objetivou-se compreender o conflito em seus aspectos multidisciplinares e formar um posicionamento crítico.pt_BR
dc.description.abstractThe present work aimed to analyze the conflict related to the exhaustive nature of the List of Procedures and Events in Supplementary Health of the National Supplementary Health Agency. We sought to analyze the Brazilian supplementary health system and the economic, financial and social aspects involved in the theme, in order to identify factual consequences arising from the decision on the nature of the ANS List. The judgment of Special Appeal No. 1,886,929 by the Superior Court of Justice was analyzed in order to identify the arguments and grounds raised by the Court that led to the understanding of the so-called mitigated taxation. In addition, an attempt was made to understand the impacts of supervening Law No. 14,454/2022, which determined the exemplary nature of the List. With this, the objective was to understand the conflict in its multidisciplinary aspects and form a critical position.pt_BR
