O escopo do presente estudo encontra essência na análise histórica, legislativa, doutrinária e jurisprudencial do sistema executivo civil, em razão de sua palpável ineficiência em atingir a tutela jurisdicional de satisfação dos interesses do exequente, com a menor onerosidade ao executado, que redundou, especialmente no final da década de 1990 e início dos anos 2000, diversas reformas do Código de Processo Civil sob a justificativa de facilitação da constrição patrimonial do devedor. Muito embora tais reformas não tenham propiciado significativas mudanças no cenário de caos jurídico conhecido no Brasil, o Novo Código de Processo Civil inovou com a edição do inciso IV, do artigo 139, cujo texto passou a autorizar a aplicação das medidas atípicas pelos juízes no que diz respeito às execuções. De tal premissa, incumbe-se a presente pesquisa em, utilizando-se do método hipotético dedutivo, por meio da análise dos entendimentos doutrinários e jurisprudenciais, determinar se as medidas atípicas representam meios constitucionais de execução e se, de fato, podem revestir-se de uma efetiva solução para a ineficiência do sistema executivo civil ante uma aparente ausência de patrimônio daqueles que integram o polo passivo das ações executivas cíveis no país.
The scope of this study is based on the analysis of the civil executive system considering historical, legislative, academic, and jurisprudential perspective with the purpose of showing the inefficiency of the system in reaching judicial protection to meet the interests of the creditor causing the least damage possible to the debtor. In the late 1990s and beginning of 2000s, this inefficiency generated several reforms on the Code of Civil Procedure under the excuse of making the arrest of debtor’s patrimony easier. Albeit these reforms have not resulted in significant changes in improving the current situation of the chaotic law system in Brazil, the New Code of Civil Procedure has innovated with the establishment of the statute 139, which has authorized the application of atypical measures by judges concerning executions. This study aims to discuss three important aspects: (i) whether these atypical measures represent constitutional ways of arresting debtor’s patrimony or not; (ii) whether they can improve the efficiency of the executive system or not; and (iii) a better way of arresting debtor’s patrimony when it seems to be nonexistent, through the analysis of academic and jurisprudential understanding. The method used in this study is hypothetical-deductive.
