Este estudo pretende analisar a ocorrência da violência obstétrica no Brasil e o papel do Direito
no seu enfrentamento, e verificar se as políticas públicas e legislações hoje existentes acerca
do tema são suficientes para prevenir e coibir esta forma recorrente de violação de direitos
fundamentais das mulheres. Para tanto, apresenta o modelo de assistência obstétrica
predominante no Brasil, assim como as críticas que lhes são dirigidas, e expõe os muitos
procedimentos clínicos rotineiros que implicam em violência obstétrica. A fim de se entender
os diferentes aspectos sociais que contribuem para sua ocorrência e perpetução, a violência
obstétrica é analisada sob uma perspectiva institucional, racial e de gênero. A metodologia
adotada em sua construção foi a revisão bibliográfica de livros, artigos, teses e outros
documentos governamentais e internacionais sobre o assunto. Por fim, concluiu-se que a
violência obstétrica no Brasil está diretamente relacionada ao modelo tecnocrático de
assistência ao parto, marcado pela medicalização do corpo feminino e uso pouco crítico de
tecnologias, assim como relaciona-se à assimetria de poder que envolve a relação médico parturiente, influenciada, em muitos casos, por estereótipos raciais e de gênero. Quanto às
legislações e políticas públicas existentes, conclui-se que estas ainda precisam ser aprimoradas
e ampliadas, destacando-se, para tanto, a necessidade da participação, em suas formulações,
dos movimentos sociais pela humanização da assistência obstétrica e da produção de dados
estatísticos seguros acerca da ocorrência dessa forma de violência.
This study intends to analyse the ocurrence of obstetric violence in Brazil and the role of the law on its facing, and to verify whether the existent public policies and legislations on the subject are enough to prevent and restrain this recurring form of women’s fundamental rights violation. To do so, this study presents the model of predominant obstetric assistance in Brazil, including the critics towards it, and exposes the many routine clinical procedures which implicate obstetric violence. In order to understand the different social aspects which contribute for its ocurrence and perpetuation, the obstetric violence is analysed under an institutional, racial, and gender perspective. The methodology adopted on its formulation was the bibliographic review of books, articles, thesis and other governmental and international documents on the subject. Finally, it was concluded that the obstetric violence in Brazil is directly related to the technocratic model of delivery assistance, marked by the medicalization of the female body and the little critical use of technologies, as well as being related to the power asymmetry that involves the relationship between the pregnant woman and her doctor, which is in many cases influenced by stereotypes of race and gender. Regarding the existent legislations and public policies, it was concluded that they still need to be improved and amplified, highlighting, for this purpose, the need of participation of the social movements for the humanization of obstetric assistance on their formulation, and the production of safe statistical data concerning this form of violence.
