Abstract
Este artigo, de caráter teórico, discorre sobre o direito à educação das crianças refugiadas e
sua inclusão na educação brasileira. O trabalho busca analisar as legislações nacionais e
internacionais que tratam o tema, identificar os desafios encontrados no processo de inserção
educacional desses sujeitos e verificar a existência de iniciativas para tal questão. O
desenvolvimento do tema decorre de pesquisas bibliográfica e documental, com uso de
método qualitativo. A razão da escolha da temática pauta-se na necessidade de proteger as
crianças refugiadas e solicitantes de refúgio quanto aos seus direitos. Esse assunto tem
repercussões no mundo jurídico, político e social, mostrando sua relevância nos dias atuais.
Nesse contexto, a educação é um recurso extremamente importante para conceder a proteção,
a assistência e a integração social para esse grupo vulnerável. Ao longo da pesquisa, percebese
que o direito à educação das crianças refugiadas é garantido pelas normas de âmbitos
nacional e internacional. No entanto, na prática, são constatadas diversas dificuldades durante
o seguimento de inclusão desses indivíduos no sistema educacional brasileiro, demandando as
ações para solucionar tais obstáculos.
This theoretical article discusses the right to education of refugee children and their inclusion in Brazilian education. It seeks to analyze the national and international legislations which deal with the theme, to identify the challenges found in the process of educational insertion of these individuals and to verify the existence of initiatives for such issue. This paper results from bibliographic and document research, using a qualitative method and it’s topic was selected due the need to protect refugees and their children, both for their rights. This subject has repercussions in the legal, political and social world, showing its relevance today. In this context, education is an extremely important resource for providing protection, assistance and social integration for this vulnerable group. Throughout the research, it is clear that refugee children’s right to education is guaranteed by national and international laws. However, in practice, it’s possible to identify several difficulties in their inclusion in the Brazilian educational system, demanding actions to solve such obstacles.
