Abstract
O surgimento e desenvolvimento das organizações criminosas, desde sua criação até os dias atuais, em suas características, peculiaridades, conceitos, atuação e história, bem como sua influência no aspecto social e a maneira como esses grupos se aproveitam das deficiências do “Estado Legítimo”, para se fortalecerem e angariarem novos membros, principalmente, em localizadas marginalizadas apontando o caos social, a insegurança e instabilidade da ordem pública e da paz social gerada por essas circunstâncias. Ainda, observa-se a função/obrigação do Estado na garantia da ordem pública e da paz social no combate ao crime organizado e a forma de combate da Colaboração Premiada trazida pela lei nº 12.850/13. O presente trabalho apresenta uma análise das organizações criminosas sob um aspecto histórico e social, apontando os problemas gerados por suas atuações, bem como o papel do Estado no combate a criminalizada organizada. Constatou-se que, devida a grande esquematização e estruturação desses grupos é necessário que o Estado, como responsável pela garantia da ordem pública e paz social, adote medidas inovadoras e novos meios de obtenção de provas, pois os comuns não se mostraram suficientes para enfraquecer e destruir as organizações criminosas. Como consequência, temos que é necessário um Estado que forneça proteção real, na qual não há uma criminalidade exacerba, mas sim uma criminalidade controlada pelo Estado e submetida a ele, tornando-o eficiente, com mecanismos fortes e poderosos para combater e enfraquecer a formação e atuação das organizações criminosas.
The emergence and development of criminal organizations, from their creation to the present day, in their characteristics, peculiarities, concepts, performance and history, as well as their influence on the social aspect and the way in which these groups take advantage of the deficiencies of the “Legitimate State” , to strengthen and attract new members, mainly in marginalized locations, pointing to social chaos, insecurity and instability in public order and the social peace generated by these circumstances. Furthermore, the State's role / obligation in guaranteeing public order and social peace in the fight against organized crime and the way of fighting the State Evidence brought by Law 12,850 / 13 are observed. The present work presents an analysis of criminal organizations from a historical and social aspect, pointing out the problems generated by their actions, as well as the role of the State in combating organized criminalization. It was found that, due to the great layout and structuring of these groups, it is necessary that the State, as responsible for guaranteeing public order and social peace, adopt innovative measures and new means of obtaining evidence, as the common ones were not sufficient to weaken and destroy criminal organizations. As a consequence, we need a state that provides real protection, in which there is no exacerbated crime, but a crime controlled by the state and subjected to it, making it efficient, with strong and powerful mechanisms to combat and weaken training. and performance of criminal organizations.
