Abstract
O presente estudo trata de elucidar a Teoria do Etiquetamento ou Rotulação Social ou ainda, Labelling Approach. Veremos suas raízes históricas tanto fáticas quanto teóricas, ponto em que abordaremos as matrizes sociológicas e criminológicas as quais fizeram surgir o Labelling Approach. Trataremos, então, de explicar o que é a Teoria do Labelling Approach e o que dizem os teóricos. Elucidaremos as novas questões trazidas pela Teoria do Labelling Approach, passando pelas definições de desvio primário, secundário, estigmatização e passaremos a demonstrar como o Labelling Approach colaborou para a redefinição dos conceitos de crime, pena e delinquente. Veremos como é o sistema penitenciário brasileiro por meio de análise de dados e após, veremos como o Labelling Approach impactou e continua impactando no sistema penitenciário.
The present study tries to elucidate the Labelling Approach Theory. We’ll see its historical roots both factual and theorical, point at which we’ll approach its sociological and criminological matrices that gave rise to the Labelling Approach. We’ll then analyze what the Labelling Approach Theory is and what the theorists say. We’ll clarify the new questions brought by the Labelling Approach Theory, passing through the definitions of primary and secondary deviance, stigmatization and after that, we’ll demonstrate how the Labelling Approach collaborated to the redefinition of the concepts of crime, penalty and delinquent. We’ll see how the Brazilian penitentiary system is by data analysis, and after that, we’ll see how the Labelling Approach Theory impacted and continues to impact the prison system.
