O aumento das demandas judiciais relacionadas à saúde no Brasil levanta preocupações sobre os impactos financeiros, a sobrecarga do sistema judiciário e o acesso ao direito à saúde. Este artigo se concentra em investigar o papel do Poder Judiciário como um ator complementar e colaborativo na promoção do direito à saúde, em cooperação com os Poderes Executivo e Legislativo. A pesquisa explora abordagens colaborativas, incluindo o Processo Estrutural e o Ativismo Judicial Dialógico, visando aprimorar a implementação de políticas públicas em resposta a omissões governamentais, com o propósito de garantir o acesso à saúde pública. Embasado em dados fornecidos pelo Conselho Nacional de Justiça sobre a judicialização da saúde entre 2020 e 2023, o estudo busca apresentar alternativas que possam resolver um problema estrutural, identificando o processo estrutural e o ativismo judicial dialógico como ferramentas eficazes em colaboração com outros órgãos do Poder Público, para lidar com questões complexas relacionadas ao chamado "estado de coisas inconstitucional." A pesquisa reflete sobre o papel do Poder Judiciário no compromisso com um sistema de saúde que atenda tanto às necessidades individuais quanto ao bem-estar da sociedade como um todo, almejando tornar o direito à saúde uma realidade acessível a todos os cidadãos.
The rising number of healthcare-related judicial demands in Brazil has raised concerns about financial impacts, the judiciary's burden, and access to the right to health. This article focuses on investigating the role of the Judiciary as a complementary and collaborative actor in promoting the right to health in cooperation with the Executive and Legislative branches. The research explores collaborative approaches, including Structural Process and Dialogical Judicial Activism, aiming to enhance the implementation of public policies in response to governmental omissions, with the purpose of ensuring access to public health. Based on data provided by the National Council of Justice regarding healthcare judicialization from 2020 to 2023, the study seeks to present alternatives that can address a structural problem, identifying the Structural Process and judicial activism as effective tools in collaboration with other branches of the Public Authority to address complex issues related to the so-called "unconstitutional state of affairs." The research reflects on the Judiciary's role in its commitment to a healthcare system that meets both individual needs and the well-being of society as a whole, aspiring to make the right to health an accessible reality for all citizens.
