Resumo
O presente artigo busca demonstrar as implicações do princípio da autonomia da vontade do paciente portador da Covid-19, sob o aspecto da bioética e do direito brasileiro, bem como a autonomia do profissional da área da saúde em poder prescrever um determinado tratamento, diante de uma situação excepcional de pandemia como a da Covid-19, em um período anterior a consecução de vacinas e em que os medicamentos não tinham sua eficácia cientificamente comprovada. Para tanto, o trabalho segue um método dedutivo, através de uma abordagem jurídico-sociológica e adota como forma de pesquisa, a pesquisa bibliográfica, documental, além de estudo de caso, em específico da Prevent Senior, que possibilitaram concluir como o profissional da área da saúde poderia estar resguardado pelo direito no contexto apresentado, bem como os limites que lhe são impostos pelo Código de Ética Médica, além da autonomia da vontade do paciente em poder optar pelo tratamento que será submetido para Covid-19, diante de uma informação clara, precisa e objetiva que lhe deve ser passada.
This article searches to demonstrate the implications of the principle of autonomy of the will on patients with Covid-19, from the perspective of bioethics and Brazilian law, as well as the autonomy of health professionals to prescribe a certain treatment, during an exceptional pandemic situation such as Covid-19, before vaccines were available and when medicines had not been scientifically proven to be effective. The work uses the deductive method, through a legal-sociological approach and adopts as a form of research, bibliographical and documentary research, in addition to case studies, specifically Prevent Senior Case, which made it possible to conclude how a professional in the area of health could be protected by the law in this context, the limits imposed to this professional by the Code of Medical Ethics, and also the autonomy of the patient's will to choose the treatment that will be submitted for Covid-19, if the information that was given to this patient was clear, precise and objective.
