O excesso legislativo no âmbito da educação superior privada e a insegurança jurídica diante desse cenário

Esse trabalho foi elaborado com base em uma análise histórica, contextual e quantitativa da legislação educacional brasileira, dos tempos coloniais até a contemporaneidade, com enfoque na educação superior privada, considerando as mudanças do comando do país e dos regimes políticos instaurados no Brasil ao longo dos anos. A partir dessa análise, evidencia-se não só um excesso legislativo, mas também certa instabilidade e imprevisibilidade legal no campo do direito educacional. Nesse sentido, e como consequência da situação evidenciada, é claro o sentimento de dúvida e insegurança jurídica por parte daqueles que estão inseridos no ensino superior privado, a saber docentes, discentes e, principalmente, mantenedores das instituições privadas de ensino. O trabalho analisa, de maneira sucinta, as diversas alterações legislativas sofridas pela Lei n. 9.394/1996 (Lei de Diretrizes e Bases, ou LDB), assim como a edição de inúmeros atos normativos infralegais. Como exemplo prático da situação em análise, traz-se o caso da Lei dos Mais Médicos – Lei nº 12.871/2013, e a abertura de novos cursos de medicina ou aumento de vagas dos já existentes, em especial após a publicação da Portaria nº 328/2018, a qual suspendeu o protocolo de pedidos de aumento de vagas e de novos editais de chamamento público para cursos de graduação em Medicina. Como resultado, resta claro o excesso de leis complementares regulando a educação do país, assim como o sentimento de insegurança que se instaura diante das constantes alterações regulatórias.
This academic work has been created based in historical analysis, contextual e quantitative from the Brazilian educational legislation, from colonial times up to contemporaneity, with focus in the private college education, taking in consideration the changes of the country command and the political regime established in Brazil over the years. From this analysis, it is evident not only the legislative excess, but also certain legal instability and unpredictability in the educational law field. In that regard, and as consequence of the evidenced situation, it is clearly the feeling of doubt and the juridical insecurity by the ones who are inserted in the private college education, a knowledge of educators, students and, mainly, maintainers of the private teaching institutions. This work analyzes, in a succinct way, the various legislative changes suffered by the Law n. 9.394/1996 (Lei de Diretrizes e Bases, or LDB), as well as the edition of numerous ifra-legal normative acts. As a practical example of the situation in analysis, it brings the case of the Lei dos Mais Médicos – Law n. 12.871/2013, and the opening of new medical courses or the increase in existing vacancies, especially after the publication of the Ordinance nº 328/2018, which suspended the protocol for requests to increase vacancies and for new public call notices for undergraduate courses in Medicine. As a result, it remains clear the excess of complementary laws regulating the education in the country, as well as the feeling of insecurity which is established in face of the constant regulatory changes.
