O presente estudo visa abordar as medidas executivas atípicas, isto é, aquelas que não estão previstas de forma restrita e taxativa no Código Processo Civil, porém autorizam ao juiz utilizar-se de diversos meios para alcançar a efetividade das execuções no âmbito civil. Dessa forma, será analisado no trabalho o artigo 139, inciso IV, do Código de Processo Civil, buscando conceituar a temática do poder geral de efetivação e entender a finalidade do legislador processual ao conceder esta demasiada autonomia para o juiz garantir o cumprimento de suas decisões. Atualmente, na doutrina e na jurisprudência, ainda há controvérsias quanto ao cabimento dos meios atípicos na execução por quantia certa, sobretudo pela natureza genérica do dispositivo processual em comento. Nesse sentido, com o intuito de não serem praticadas arbitrariedades e violações de preceitos fundamentais, tanto do credor quanto do devedor dentro de uma relação jurídica, a observância de critérios para a aplicação das medidas executivas atípicas se torna imprescindível por parte do julgador.
The present study aims to address the atypical executive measures, that is, those that are not strictly and exhaustively provided for in the Civil Procedure Code but authorize the judge to use various means to achieve the effectiveness of executions in the civil sphere. In this way, article 139, item IV, of the Code of Civil Procedure will be analyzed in the work, seeking to conceptualize the theme of the general power of effectiveness and to understand the purpose of the procedural legislator in granting this too much autonomy for the judge to guarantee compliance with his decisions. Currently, in doctrine and jurisprudence, there are still controversies regarding the appropriateness of atypical means in the execution for a certain amount, especially due to the generic nature of the procedural device in question. In this sense, in order to avoid arbitrariness and violations of fundamental precepts, both of the creditor and the debtor within a legal relationship, the observance of criteria for the application of atypical executive measures becomes essential on the part of the judge.
