dc.description.abstractEste estudo apresenta uma análise da relação do Estado Brasileiro com a tutela dos bens culturais materiais móveis, especificamente aqueles conhecidos como “obras de arte”. Por meio do método hipotético-dedutivo, com utilização de pesquisa qualitativa de legislação e doutrina, com um breve apanhado histórico de normas internacionais relativas à relação das nações com seus bens culturais, sobretudo em momentos de guerra, passando pelo marco fundamental da legislação protetiva que foi a Revolução Francesa. Na sequência deste apresenta quais aparatos o Estado francês lançou mão para efetivar a intenção da tutela para, enfim, chegar às legislações pátrias e as soluções aqui encontradas para o mesmo propósito. Do primeiro decreto-lei às mais recentes normas sobre o tema, também apresenta as peculiaridades da tutela invariavelmente entendida como de bem imóvel, para bens móveis e mesmo imateriais. Pois, para além da evolução legislativa veremos que o próprio conceito de bem cultural a ser tutelado evoluiu, penetrando no tecido social, para além das elites históricas. São discutidos dois pontos práticos, a edição do decreto-lei 8.124 de 2013 e os casos das pinturas “Miséria e Caridade” e “Abaporu”.
dc.description.abstractThis study presents an analysis of the relationship between the Brazilian State and the guardianship of movable cultural goods, specifically those known as "works of art". Using the hypothetical-deductive method, with qualitative research of legislation and doctrine, it includes a brief historical overview of international norms relating to the relationship of nations with their cultural assets, especially in times of war, starting with the fundamental milestone of protective legislation that was the French Revolution. Following this, it presents the devices the French State employed to effectuate the intention of guardianship, ultimately leading to national legislations and the solutions found here for the same purpose. From the first decree-law to the most recent norms on the topic, it also details the peculiarities of guardianship invariably understood as concerning immovable property, applied to movable and even intangible goods. Beyond the legislative evolution, it is observed that the very concept of a cultural good to be safeguarded has evolved, penetrating the social fabric, beyond the historical elites. Two practical points are discussed: the enactment of decree-law 8.124 of 2013 and the cases of the paintings "Miséria e Caridade" and "Abaporu".
