A sociedade brasileira permanece sendo palco de diversos debates socioculturais
relacionados à discriminação de gênero. Em que pese a previsão constitucional referente à
isonomia, conforme consagrado pelo artigo 5º, da Constituição Federal, bem como as demais
previsões referentes ao tema no âmbito internacional, tal como a “Convenção sobre a
eliminação de todas as formas de discriminação contra a mulher”, demonstrando a relevância
mundial do objeto da pesquisa, ainda assim persiste, no cenário contemporâneo, os atos
discriminatórios direcionados à mulher, de forma a acarretar diversas demandas judiciais
propostas a fim de que o Poder Judiciário decida pela igualdade entre homens e mulheres,
contribuindo para uma transformação social. Diante de tal contexto, o presente artigo busca
analisar se o devido processo legal, princípio processual constitucional que possui o intuito
principal de assegurar a todos os indivíduos o direito a um processo pautado em todas as normas
e princípios do ordenamento jurídico, de modo a concretizar as demais garantias
constitucionais, bem como evitar arbitrariedades do poder estatal, promovendo a igualdade
social, demonstra-se suficiente para a efetiva tutela de direitos femininos no âmbito do Poder
Judiciário contemporâneo ou, se este, respaldado em uma ideologia de dominação decorrente
do patriarcalismo estrutural, acarreta em certa perpetuação dos preconceitos de gênero como
forma de dominação ainda existente nas relações interpessoais.
Brazilian society is still the scene of several sociocultural debates related to gender discrimination. Despite the constitutional provision referring to isonomy, as enshrined in article 5th of the Federal Constitution, as well as the other provisions referring to the subject at the international level, such as the “Convention on the elimination of all forms of discrimination against the woman", demonstrating the worldwide relevance of the research object, still persists, in the contemporary scenario, discriminatory acts directed at women, in order to lead to several proposed judicial demands so that the Judiciary can decide for equality between men and women , contributing to social transformation. Due to this context, this article is intended to analyze whether due process of law, a constitutional procedural principle that has the main purpose of ensuring that all individuals have the right to a process based on all the norms and principles of the legal system, in order to achieve other constitutional guarantees, as well as avoiding arbitrariness by state power, promoting social equality, proves to be sufficient for the effective protection of women's rights within the scope of the contemporary Judiciary or, if this, supported by an ideology of domination arising from structural patriarchy, entails a certain perpetuation of gender prejudices as a form of domination that still exists in interpersonal relationships.
