dc.description.abstractA presente pesquisa se propõe a instigar uma reflexão jurídica e social acerca do direito real de laje, um direito real autônomo e independente, com natureza de direito real sobre coisa própria. Exploram-se, inicialmente, os direitos reais de um modo geral, abordando-se os principais institutos jurídicos relacionados ao estudo do direito real de laje propriamente dito, como a posse, a propriedade e a superfície. Além disso, num segundo momento, explana-se sobre o direito real de laje, relatando-se a sua origem social e, também, a sua origem jurídica. Outrossim, a pesquisa traz o conceito do direito real de laje, sua natureza jurídica, a terminologia aplicada a este direito, bem como as espécies de laje previstas ne legislação. Por fim, estudam-se as formas de aquisição do direito real de laje, seu procedimento registral, suas semelhanças e diferenças com o condomínio edilício e a constitucionalidade do direito real objeto do presente estudo.pt_BR
dc.description.abstractThe present research proposes to instigate a juridical and social reflection on the real right of “laje”, an autonomous and independente real right, with nature of real right on own thing. Initially, it explores real rights in general, addressing the main legal institutes related to the study of the real right of “laje” itself, such as possesion, property and surface. In addition, in a second moment, it is explored on the real right of “laje”, being related to its social origin and also its legal origin. Also, the research brings the concept of the real right of “laje”, its legal nature, the terminology applied to this right, as well as the species of “laje” provided in the legislation. Finally, are studied the forms of acquisition of the real right of “laje”, its registration procedure, its similarities and differences with the condominium building and the constitutionality of the real right object of the present study.pt_BR
