Abstract
O presente trabalho tem por objetivo analisar, subjetivamente, como as interações entre os apenados que se encontram dentro das prisões paulistas se regulam através das vontades de um terceiro, o Primeiro Comando da Capital (PCC). Tal figura assenhora-se do papel do Estado, tornando-se regulador e mediador das relações sociais que se estabelecem dentro daquele sistema prisional e, além disso, evita que o homem volte ao seu estado de natureza, onde ele é ruim e voltado à destruição conforme afirma Thomas Hobbes e, por consequência, evita que o homem cometa ações ruins em prol da sua sobrevivência. Para entender o contexto de estado de natureza do homem, foi utilizada a teoria do “estado de natureza” do autor e filosofo inglês Thomas Hobbes, na qual ele afirma que “O homem é o lobo do homem” e a teoria contratualista deste, segundo a qual o Estado surge para regular as relações e transformar o estado de natureza no estado social.
Com os argumentos já identificados, o presente trabalho demonstra como a facção PCC é capaz de controlar o sistema prisional paulista e os detentos daquele local, inclusive com a própria autorização do Estado quando este, na figura do Estado-Juiz questiona, na audiência de custódia, se o detento faz parte de “alguma facção” e “qual a facção” para que este seja enviado, em prol do seu bem-estar, para o presídio controlado pela facção mencionada por este.
The present work aims to analyze, subjectively, how the interactions between the convicts who are inside São Paulo prisons are regulated through the will of a third, the First Command of the Capital (PCC). Such a figure, which mastering the role of the State, become a regulator and mediator of the social relations that are established within that prison system and, in addition, it prevents man from returning to his state of nature, where he is bad and tends to destruction as stated by Thomas Hobbes and, consequently, it prevents man from committing bad actions in favor of his survival. For understand the context of man's state of nature, the theory of "state of nature" by the English author and philosopher Thomas Hobbes, in which he states that "man is a wolf to man" and the latter's contractualist theory, according to which the State appears to regulate relationships and transform the state of nature into the social state. With the arguments already identified, the present work demonstrates how the PCC faction is able to control the São Paulo's prison system and the detainees of that place, including with the State's own authorization when the State, including, in the figure of the State-Judge, questions, at the hearing of custody, whether the detainee is part of “a faction” and “which faction” so that thisbe sent, for the sake of his welfare, to the prison controlled by the faction mentioned by This one.
