dc.description.abstractEste trabalho versa sobre o parcelamento de imóvel rural no Brasil e, para isso, apresenta o histórico do instituto e os diversos regimes jurídicos aplicáveis. Primeiramente, se fez necessária uma breve análise da função social da propriedade, princípio inserido pela Constituição de 1988. Em seguida, aborda os conceitos, definições e classificações do imóvel rural. A seguir, discorreu sobre o módulo rural, descrito no art. 4º, inciso II, do Estatuto da Terra, cuja finalidade é impedir que se proliferem os imóveis com área inferior ao adequado para o desenvolvimento humano. A partir dele também se originou o instituto da Fração Mínima, que determina a área mínima que pode ser fracionada perante o Registro de Imóveis para a formação de um novo imóvel rural. Analisou-se brevemente o sistema cadastral de um imóvel rural, aqui, para fins de estudo do parcelamento do imóvel rural, destaca-se o CCIR, um dos documentos mais importantes, principalmente, no que diz respeito à legalização, junto ao cartório, de desmembramento de imóvel. Posteriormente, avaliou-se a evolução histórica e normativa do parcelamento do solo no Brasil, apontando o surgimento da Lei de Terras, em 1964, do Estatuto da Terras, uma das leis até hoje de maior relevância relacionado ao imóvel rural e da Instrução Normativa INCRA 17-B. Por fim, estudou-se o procedimento de registro do parcelamento do solo rural perante o Registro de Imóveis.pt_BR
dc.description.abstractThis paper discusses the subdivision of the rural property in Brazil, in this regard, it presents the history of the institute and the various applicable legal regimes. First, a brief analysis of the social function of property was necessary, a principle inserted by the 1988 Constitution. Then, it approaches the concepts, definitions and classifications of rural property. Then, spoke about the rural module, described in art. 4, item II, of the Land Statute, whose purpose is to prevent the proliferation of properties with an area that is less than adequate for human development. From it also originated the Minimum Fraction Institute, which determines the minimum area that can be fractionated before the Real Estate Registry for the formation of a new rural property. The cadastral system of a rural property was briefly analyzed, here, for the purpose of studying the subdivision of rural property, the CCIR stands out, one of the most important documents, mainly with regard to legalization of the dismemberment with registry office. Subsequently, the historical and normative evolution of land subdivision in Brazil was evaluated, pointing out the emergence of the Land Law, in 1964, of the Land Statute, one of the most relevant laws related to rural property and the INCRA Normative Instruction 17-B. Finally, the procedure for registering the subdivision of rural land before the Real Estate Registry was studied.pt_BR
