Pesquisa científica no Brasil : a correlação entre fomento de pesquisa científica e produção científica de impacto

| dc.description.abstract | A presente tese se desenvolve na perspectiva de apresentar algumas reflexões sobre a produção de pesquisa jurídica no Brasil, objetivando verificar a existência de uma correlação entre os investimentos realizados em pesquisa científica, os critérios de produção de pesquisa científica de impacto e a consequente contribuição dessas pesquisas para o desenvolvimento econômico e normativo brasileiro. Em outras palavras, o estudo visa identificar a forma e as áreas de conhecimento receptoras de investimentos em pesquisa científica no Brasil para observar como os recursos são destinados à pesquisa em ciência jurídica e se essas pesquisas de fato contribuem para a construção normativa e econômica do país ou se é apenas um produto das universidades destinado às próprias instituições. Como orientação metodológica, adota-se o método hipotético-dedutivo de pesquisa científica e a técnica de pesquisa bibliográfica, a partir de fontes secundárias como referencial de base. O estudo se estrutura em quatro capítulos, necessários para compreender como os métodos de pesquisa se consolidaram ao longo do desenvolvimento histórico da humanidade, ou seja: conhecer como ocorreu a organização das estruturas estatais voltadas à pesquisa científica no Brasil, o panorama de fomento em pesquisa científica em ciências sociais aplicadas no nosso país e no mundo, de forma a trazer evidências para delinear a comparação entre o comportamento dos recursos originados no Brasil e aqueles provenientes de outras agências mundiais; e, por fim, evidenciando como métricas e fatores de impacto da pesquisa científica jurídica contribuem para o critério de qualificação da pesquisa científica no Brasil, verificar qual seria a correlação efetiva entre produção bibliográfica de impacto e sua contribuição para o desenvolvimento da gestão pública brasileira. A análise dos fatores propostos – fomento da pesquisa científica, impacto da pesquisa segundo critérios propostos pela academia e sua contribuição para o desenvolvimento normativo –, respalda-se, de forma análoga, ao modelo denominado de “Triple Helix” ou “Tríplice Hélice da Inovação” proposto pelos pesquisadores Etzkowitz e Leydesdorff no início da década de 1990. As conclusões trazidas como resultado do esforço da presente pesquisa abordam a necessidade de se repensar o propósito da pesquisa científica e de seus critérios de qualificação, considerando o baixo aproveitamento pelo poder judiciário e legislativo dos estudos realizados pelas universidades. Ou seja, as pesquisas produzidas pelas universidades sejam elas financiadas ou não, não são utilizadas como substrato científico para a construção normativa e social do país pelo judiciário e legislativo. O aumento ou diminuição dos recursos destinados ao fomento de pesquisa em direito não contribuirá com o aumento do aproveitamento das pesquisas, pois o problema está no fato de as pesquisas produzidas não serem utilizadas pelos poderes judiciário e legislativo. | |

| local.description.abstracten | This thesis is developed from the perspective of presenting some reflections on the production of legal research in Brazil, aiming to verify the existence of a correlation between investments made in scientific research, the criteria for producing impact scientific research and the consequent contribution of these research. for Brazilian economic and regulatory development. In other words, the study aims to identify the form and areas of knowledge that receive investments in scientific research in Brazil, in order to observe how resources are allocated to research in legal science and whether these research actually contribute to the normative and economic construction of the country. or if it is just a product of the universities destined for the institutions themselves. As a methodological guideline, the hypothetical-deductive method of scientific research and the technique of bibliographic research are adopted, using secondary sources as a base reference. The study is structured in four chapters, necessary to understand how research methods were consolidated throughout the historical development of humanity, that is: to know how the organization of state structures focused on scientific research in Brazil took place, the panorama of research promotion scientific research in applied social sciences in our country and in the world, in order to bring evidence to delineate the comparison between the behavior of resources originating in Brazil and those coming from other global agencies; and, finally, showing how metrics and impact factors of legal scientific research contribute to the qualification criterion of scientific research in Brazil, to verify what would be the effective correlation between impact bibliographic production and its contribution to the development of Brazilian public management. The analysis of the proposed factors - promotion of scientific research, impact of research according to criteria proposed by the academy and its contribution to normative development -, is similarly supported by the model called "Triple Helix" or "Triple Helix of Innovation” proposed by researchers Etzkowitz and Leydesdorff in the early 1990s. The conclusions brought because of the effort of this research address the need to rethink the purpose of scientific research and its qualification criteria, considering the low use by the judiciary and legislation of studies conducted by universities. In other words, research produced by universities, whether financed or not, is not used as a scientific substrate for the normative and social construction of the country by the judiciary and the legislature. The increase or decrease in resources destined to the promotion of research in law will not contribute to the increase in the use of research, since the problem lies in the fact that the research produced is not used by the judiciary and legislative powers. | |
