Resumo
O problema de pesquisa desse trabalho consiste em quais são as limitações do direito
de greve em um sistema de unicidade sindical. O objetivo geral era estudar e entender
melhor as limitações ao direito de greve no Brasil, enquanto o objetivo específico era
analisar as possibilidades do exercício de greve pelos trabalhadores sem a
participação dos sindicatos. A metodologia foi de natureza básica, sendo que em
relação à abordagem do problema a pesquisa foi qualitativa e em relação aos objetivos
essa se mostrou exploratória. O método utilizado foi o dedutivo e o material foi
essencialmente bibliográfico, passando por legislação, doutrina, dados e
jurisprudência. A conclusão a que foi possível se chegar foi que o sistema de sindicato
único representa uma limitação, ainda que indireta, ao direito de greve, uma vez que,
embora a titularidade do direito de greve seja do trabalhador individual, o exercício do
direito é, geralmente, do sindicato, de forma que que a deflagração sem a participação
do sindicato possibilita a declaração de abusividade da greve por parte da
jurisprudência.
The research problem of this work consists of what are the limitations of the right to strike in a single union system. The general objective was to study and better understand the limitations to the right to strike in Brazil, while the specific objective was to analyze the possibilities of workers exercising the right to strike without the participation of unions. The methodology was basic in nature, and in relation to the approach to the problem the research was qualitative, and in relation to the objectives it was exploratory. The method used was deductive and the material was essentially bibliographical, going through legislation, doctrine, data and jurisprudence. The conclusion that could be reached was that the single union system represents a limitation, albeit indirect, to the right to strike, since, although the right to strike belongs to the individual worker, the exercise of the right is usually the union's, so that deflagration without the union's participation makes it possible for the jurisprudence to declare the strike abusive.
