O presente artigo tem por finalidade precípua analisar se a pandemia de Covid-19 pode ser considerada como fato superveniente, extraordinário e imprevisível, capaz de dar ensejo à aplicação da teoria da imprevisão para fins de revisão e resolução contratual. A superveniência da pandemia de Covid-19 levou ao questionamento quanto à possibilidade de revisão ou até mesmo de resolução dos contratos, os quais haviam sido celebrados anteriormente à pandemia (em um cenário econômico estável), e que estavam sendo executados em um cenário de crise pandêmica. Partindo dessa problemática, pretende-se analisar, com base nos conceitos doutrinários da teoria da imprevisão, e na jurisprudência pátria, se essa preponderante teoria do direito contratual seria aplicável aos contratos afetados pela crise pandêmica, cuja obrigação de uma parte se tornou extremamente difícil de ser cumprida, visando, assim, ao restabelecimento do equilíbrio contratual, mediante a revisão do contrato.
The main purpose of this article is to analyze whether the Covid-19 pandemic can be considered as a supervening, extraordinary and unpredictable fact, capable of giving rise to the application of the theory of unpredictability for purposes of review and contractual resolution. The supervenience of the Covid-19 pandemic led to questions about the possibility of revising or even terminating the contracts, which had been signed prior to the pandemic (in a stable economic scenario), and which were being executed in a crisis scenario pandemic. Based on this problem, we intend to analyze, based on the doctrinal concepts of the theory of unpredictability, and on the domestic jurisprudence, if this preponderant theory of contract law would be applicable to contracts affected by the pandemic crisis, whose obligation of a party has become extremely difficult to be fulfilled, thus aiming at the reestablishment of the contractual balance, through the revision of the contract.
