O acolhimento institucional é uma medida de urgência, de caráter temporário, prevista no Estatuto da Criança e do Adolescente, nos casos em que se faça necessário o afastamento da criança ou adolescente do ambiente que o exponha ao risco. O processo de institucionalização em abrigo traz consigo sentimentos antagonistas, por um lado o consolo de ter saído do ambiente ameaçador e por outro, a sensação de abandono, solidão e desamparo. Os sentimentos nebulosos relacionados ao abrigamento acompanham a trajetória dos institucionalizados, na entrada, durante a permanência, até o desligamento. Nesse sentido, se faz necessário compreender as principais razões de acolhimento e se elas são as mesmas para crianças e adolescentes típicas e crianças e adolescentes portadores de deficiência. Logo, o presente trabalho tem como objetivo analisar a trajetória daqueles que portam alguma deficiência e são acolhidos em abrigos institucionais na infância ou adolescência, principalmente como o desacolhimento obrigatório ocorre para essas pessoas e quais as lacunas legais existentes. Tal artigo é resultado de uma pesquisa desenvolvida através da análise de variados relatórios, artigos e doutrinas, que exponham a ausência/escassez de legislação que vise proteger crianças e adolescentes portadores de deficiência em acolhimento institucional. O objetivo é ressaltar as consequências práticas ocasionadas por essa omissão legal, por intermédio de pesquisa multidisciplinar, com natureza sociológica jurídica, utilizando-se do método indutivo, partindo de uma lacuna legislativa, para compreender os efeitos dessa ausência.
Institutional reception is an emergency, temporary measure provided for in the Statute of the Child and Adolescent, in cases where it is necessary to remove the child or adolescent from an environment that exposes them to risk. The process of institutionalization in a shelter brings with it conflicting feelings, on the one hand the comfort of having left the threatening environment and on the other, the feeling of abandonment, loneliness and helplessness. The nebulous feelings related to institutionalization accompany the trajectory of those who are institutionalized, from admission, during their stay, until their departure. In this sense, it is necessary to understand the main reasons for reception and whether they are the same for typical children and adolescents and for children and adolescents with disabilities. Therefore, this work aims to analyze the trajectory of those who have some disability and are received in institutional shelters in childhood or adolescence, mainly how the mandatory discharge occurs for these people and what legal gaps exist. This article is the result of research developed through the analysis of various reports, articles and doctrines that expose the absence/scarcity of legislation aimed at protecting children and adolescents with disabilities in institutional reception. The objective is to highlight the practical consequences caused by this legal omission through multidisciplinary research, with a sociological and legal nature, using the inductive method, starting from a legislative gap to understand the effects of this absence.
