Sancionado em abril de 2014, o Marco Civil da Internet é um dispositivo que tem como objetivos estabelecer diretrizes para o uso da internet no Brasil, abordando questões como a privacidade, liberdade de expressão, neutralidade da rede e responsabilidade dos provedores de serviços online. No entanto, a referida lei tem sido objeto de críticas por não prever a responsabilidade dos provedores de internet por danos decorrentes de atos ilícitos praticados por terceiros em suas plataformas, elevando o direito fundamental à liberdade de expressão acima dos direitos fundamentais à privacidade, intimidade e proteção ao consumidor. Apesar de a regra ser a responsabilização civil do usuário gerador do conteúdo ilícito pelos danos causados por suas ações em plataformas de redes sociais, em certos contextos, a norma comporta exceções nas quais os provedores dessas redes sociais também podem ser responsabilizados. Desta forma, o presente trabalho busca analisar os aspectos relacionados à responsabilização dos provedores pelos danos causados em vista de conteúdos postados em suas plataformas, colocando em pauta o Marco Civil da Internet e o entendimento jurisprudencial atual, correlacionando-os com os direitos fundamentais e princípios à luz do Código de Defesa do Consumidor. Quanto à metodologia, a pesquisa possui cunho bibliográfico e jurisprudencial em relação aos resultados, desenvolvido por meio de pesquisa teórica. A título de resultados, pretende-se demonstrar que o modelo adotado atualmente pelo Marco Civil da Internet talvez não seja tão coeso e ideal frente aos direitos fundamentais e demais princípios civis e constitucionais que serão analisados.
Signed into law in April 2014, the Brazilian Civil Rights Framework for the Internet aims to establish guidelines for the use of the internet in Brazil, addressing issues such as privacy, freedom of expression, net neutrality and the liability of online service providers. However, this law has been criticized for not providing for the liability of internet providers for damages arising from illegal acts committed by third parties on their platforms, elevating the fundamental right to freedom of expression above the fundamental rights to privacy, intimacy and consumer protection. Although the rule is that the user who generates the illegal content is held civilly liable for the damage caused by their actions on social media platforms, in certain contexts, the rule includes exceptions in which the providers of these social networks can also be held liable. In this way, this work seeks to analyze the aspects related to the liability of providers for damages caused by content posted on their platforms, putting the Marco Civil da Internet and current jurisprudential understanding on the agenda, correlating them with fundamental rights and principles in the light of the Consumer Protection Code. In terms of methodology, the research is bibliographical and jurisprudential in nature, and the results are developed through theoretical research. In terms of results, the aim is to demonstrate that the model currently adopted by the Marco Civil may not be as cohesive and ideal as the fundamental rights and other civil and constitutional principles that will be analyzed.
