Analisa-se a Teoria das Janelas Quebradas - suas intersecções com o Momento Lei e Ordem - e sua influência na formação e direcionamento de políticas de segurança pública preventivas e ostensivas. Tal análise é feita a partir do estudo teórico e empírico da criação e aplicação de políticas criminais pautadas na referida teoria e no movimento lei e ordem, e operação tolerância zero com mais prisões, bem como seus reflexos na contemporaneidade, combinando-se o dever de punir do Estado com o quanto previsto a Constituição/CF, e no microssistema dos Juizados Especiais Criminais - Jecrim, em relação à aplicação do “Direito Penal Máximo” e do “Direito Penal Mínimo” como ultima ratio. Objetiva-se examinar acerca das oscilações de crescimento da criminalidade ante aplicação medidas coercitivas mais ou menos severos e sua aceitação pela sociedade. Para tanto, estuda-se material teórico acerca das origens e funções das teorias referenciadas, bem como modelos ditos modernos de políticas criminais no combate à criminalidade
The Theory of Broken Windows - its intersections with the Law and Order Moment - and its influence on the formation and direction of preventive and ostensive public policies of public security are analyzed. This analysis is based on the theoretical and empirical study of the creation and application of criminal policies based on the said theory and on the law and order movement, and zero tolerance operation with more prisons, as well as their reflexes in the contemporaneity, combining the duty of punish the State with the provisions of the Constitution / 88, and in the microsystem of the Special Criminal Courts - Jecrim, in relation to the application of "Maximum Criminal Law" and "Minimum Criminal Law" as ultima ratio. The objective is to examine the fluctuations of growth of criminality by applying more or less severe coercive measures and their acceptance by society. For this, theoretical material on the origins and functions of the referenced theories is studied, as well as modern models of criminal policies in the fight against crime
