Este trabalho aborda a problemática do filicídio no contexto jurídico brasileiro,
examinando como a legislação e a jurisprudência tratam casos em que pais matam seus filhos.
A partir de uma análise comparativa entre filicídio e infanticídio, a pesquisa busca identificar
as consonâncias e divergências entre esses dois conceitos, explorando também a violência
doméstica e suas manifestações na infância, incluindo fatores psicossociais que contribuem
para esses atos. O trabalho se aprofunda na análise de casos de grande repercussão no Brasil,
examinando as sentenças judiciais associadas e observando como a Constituição Federal lida
com tais crimes. Para entender melhor o conceito de filicídio, são exploradas suas origens
históricas e mitológicas, bem como sua evolução ao longo do tempo. A pesquisa também
destaca como a legislação brasileira trata o filicídio, discutindo a dosimetria das penas, as
jurisprudências relevantes e como a lei tende a ser mais branda em casos onde há evidência de
doenças mentais. Na última parte do trabalho, a atenção é direcionada para o crime de filicídio
associado a patologias psicossociais dentro do Direito Penal Brasileiro. Este segmento examina
a psicodinâmica do impulso filicida e considera a influência da doença mental e outros
modificadores da imputabilidade penal nesses casos. Além disso, a discussão aborda aspectos
do sistema penal, como a alta progressiva de pacientes de manicômios judiciários e a
reabilitação daqueles que foram considerados inimputáveis devido a problemas de saúde
mental.
This work addresses the issue of filicide in the Brazilian legal context, examining how legislation and jurisprudence treat cases in which parents kill their children. Based on a comparative analysis between filicide and infanticide, the research seeks to identify the consonances and divergences between these two concepts, also exploring domestic violence and its manifestations in childhood, including psychosocial factors that contribute to these acts. The work delves into the analysis of high-profile cases in Brazil, examining the associated court sentences and observing how the Federal Constitution deals with such crimes. To better understand the concept of filicide, its historical and mythological origins are explored, as well as its evolution over time. The research also highlights how Brazilian legislation treats filicide, discussing the dosimetry of penalties, relevant jurisprudence and how the law tends to be more lenient in cases where there is evidence of mental illness. In the last part of the work, attention is directed to the crime of filicide associated with psychosocial pathologies within Brazilian Criminal Law. This segment examines the psychodynamics of the filicidal impulse and considers the influence of mental illness and other modifiers of criminal liability in these cases. Furthermore, the discussion addresses aspects of the penal system, such as the progressive discharge of patients from judicial asylums and the rehabilitation of those who were considered unaccountable due to mental health problems.
