O presente trabalho nasceu de um grande incômodo com o sistema penal atual, o
encarceramento em massa se tornou a tônica mundial como resposta à crescente
criminalidade a partir da década de 1960, contudo, o aumento do número de presos não
se refletiu em uma diminuição da quantidade de crimes. A pena, em sua função de
prevenção geral e especial – seja na modalidade negativa ou positiva, tem se mostrado
ineficiente aos fins que almeja. As ideias positivistas de atrelar o crime à miséria, que
pareceram permanentemente superadas, ressurgem e contribuem para uma política
criminal segregacionista que em nada impacta na redução do número de crimes. O
sistema penal não consegue processar o universo de crime, e quando o faz, é de forma
seletiva. Apesar de todos esse problemas apontados, o direito penal não inova e continua
lidando com a criminalidade da mesma maneira, respondendo o crime com mais punição.
Se o sistema penal tem falhas que provocam debates há mais de meio século, para dizer
o mínimo, por que continuar insistindo nele? Essa é a pergunta que se pretende responder
pelo prisma da criminlogia crítica, sobretudo pelos pensamentos das escolas minimalista
e abolicionista penal, bem como pelo realismo de esquerda .
This work has arisen due to a frustration with the current penal system. The mass incarceration has become the main answer for the increase of criminality since the 1960s. However, the growth of incarceration numbers has not reflected decrease in the amount of crimes. The effect of the punishment, either in the special prevention aspect or in the general prevention aspect, has not proven itself as effective as it is claimed. The Positivism idea, which relates crimes to poverty, once overcome, has risen again and has been applied in a segregationist criminal policy that continues to be ineffective in order to fight against criminality. The criminal justice system is unable to prosecute the whole universe of crimes and, as a result, the criminal lawsuits are most of the time selective with respect to prosecution. Despite of this entire problem, the criminal law insists to deal with the crime in the same way as past years: answering it with more punishment. Therefore, the debates of how to solve the criminal problem are practically the same for, at least, half a century, so why to insist on this system? This is precisely the question which this work aims to respond, based on the critical criminology such as the prison abolition movement school and the left realism school.
