Resumo
A presente monografia tem como objetivo estudar sobre a judicialização da medicina,
bem como definir o conceito de erro médico e como a responsabilidade penal do profissional
da medicina é configurada. A partir de análises bibliográficas entendemos como surge a relação
entre médicos e pacientes e como se forma a necessidade de tal relação ser levada ao judiciário.
Estudamos, também, quais são os conceitos de crime e elementos subjetivos adotados pelo
ordenamento jurídico brasileiro. Além disso, a partir da definição de dolo e das modalidades de
culpa, entendemos: (i) como se configura o erro médico; (ii) como se caracteriza a
responsabilidade penal médica e (iii) como a Lex Artis rege e determina as condutas que devem
ser tomadas pelos médicos em determinadas situações. Finalmente, realizamos uma análise
jurisprudencial de julgados do Supremo Tribunal Federal, do Superior Tribunal de Justiça e do
Tribunal de Justiça de São Paulo para compreender como a responsabilidade penal médica e o
erro médico são analisados e julgados por estes tribunais.
This paper aims at studying the judicialization of medical practice as well as defining the concept of medical malpractice and how the legal responsibility of the medical professional is configured. Starting from a number of bibliographical analysis we understand how the doctorpatient relation arises and what is the necessity of such relation being taken to court. We also studied what are the concepts of crime and the subjective elements adopted by the Brazilian legal order. Besides that, starting from the definition of malice and the modalities of guilt we understand: (i) How medical malpractice is configured (ii) how legal medical responsibility is characterized and (iii) how the Lex Artis reigns ands determines which conducts should be taken by doctors in different situations. Therefore we reached a jurisprudential analysis based on beforehand observed cases from the Supremo Tribunal Federal, from the Supremo Tribunal de Justiça and from the Tribunal de Justiça de São Paulo to comprehend how legal medical responsibility and how medical malpractice are analyzed and judged by theses courts.
