Abstract
A multiparentalidade é um fenômeno recentemente reconhecido pelo STF através do
julgamento do Recurso Extraordinário 898.060/SC (Tema 622). É o parentesco constituído por
múltiplos pais, isto é, quando o filho estabelece uma relação de paternidade/maternidade com
mais de um pai ou mais de uma mãe, um pai/mãe biológico e outro socioafetivo. Se tornou uma
realidade jurídica, impulsionada pela dinâmica da vida e pela compreensão de que a paternidade
e a maternidade são funções exercidas. O reconhecimento desse fenômeno gera efeitos jurídicos
próprios, como direitos sucessórios, alimentos, guarda compartilhada e previdenciários.
Partindo desta ideia, o presente trabalho tem como objetivo, verificar os efeitos do
reconhecimento da paternidade socioafetiva e da multiparentalidade no âmbito civil e
previdenciário. Para tanto, foi consultada a doutrina que versa sobre a paternidade socioafetiva
e multiparentalidade e seu reconhecimento, legislações que abordam como temática os direitos
e deveres advindos da paternidade socioafetiva e da pluriparentalidade, além dos julgados
proferidos pelos tribunais brasileiros acerca do assunto.
"Multiparenting" is a phenomenon recently recognized by the Supreme Federeal Court through the judgment of Extraordinary Appeal 898.060/SC (Theme 622). It is the kinship formed by multiple parents, that is, when the child establishes a paternity/maternity relationship with more than one father or more than one mother , a biological parent and a socio-affective parent. It has become a legal reality, driven by the dynamics of life and the understanding that paternity and motherhood are functions exercised. The recognition of this phenomenon has its own legal effects, such as inheritance rights, aliment, shared custody and social security. Based on this idea, the present work aims to verify the effects of the recognition of socio-affective paternity and "multiparenting" in the civil and social security spheres. For this purpose, the legal literature on socio-affective and "multiparenting" and its recognition was consulted, laws that address the rights and duties arising from socio-affective and "multiparenting" as a theme, in addition to those judged by brazilian courts on the subject.
