Análise prática do caso Gugu Liberato: reconhecimento do companheiro como herdeiro necessário e possibilidade de reconhecimento de união estável simultânea

Resumo
Este artigo tem por objetivo analisar o caso prático do apresentador Gugu Liberato, delimitando como escopo os seguintes temas: (i) impactos da equiparação do instituto da união estável ao casamento no direito sucessório, especificamente no que se refere à inclusão do companheiro no rol de herdeiros necessários, estabelecido nos termos do art. 1.845 do Código Civil; e (ii) possibilidade de reconhecimento de uniões estáveis simultâneas. Insta destacar que referidos temas são de suma relevância não apenas para resolução do caso em tela, mas também para atribuir maior segurança jurídica às diversas conjecturas familiares que se encontram nessas mesmas situações, evidenciando-se a inquestionável necessidade de abordagem sobre o tema para que as omissões e divergências sejam superadas. Contudo, insta ressaltar que esta análise não tem por escopo exaurir o tema, mas sim evidenciar questionamentos e trazer apontamentos que sejam pertinentes para a melhor compreensão dos institutos e dos desafios contemporâneos que se impõem ao Direito ante os novos fenômenos familiares e sucessórios. Para tanto, utilizou-se como metodologia a pesquisa bibliográfica e documental, mediante estudo legislativo, doutrinário e jurisprudencial. Bem como, estudo de caso, que consiste na investigação aprofundada considerando o contexto e as peculiaridades do caso analisado. Após profunda pesquisa, o presente artigo concluiu que apesar de haver uma evidente inclinação dos tribunais estudais e da doutrina pela inclusão do companheiro como herdeiro necessário, com fulcro no argumento de inconstitucionalidade da distinção de tratamento entre os núcleos familiares, o posicionamento do Supremo Tribunal Federal (“STF”) permanece omisso. A possibilidade de reconhecimento de uniões estáveis simultâneas, por sua vez, foi declarada inconstitucional pelo STF. Portanto, em conflitos de famílias coexistentes, é inevitável o reconhecimento da legitimidade de um núcleo em detrimento do outro, para fins de extensão e aplicabilidade da proteção estatal.
This article aims to analyze the practical case of presenter Gugu Liberato, delimiting the following themes as scope: (i) impacts of the equalization of the institute of stable union to marriage in inheritance law, specifically with regard to the inclusion of the partner in the list of necessary heirs, established under the terms of art. 1,845 of the Civil Code; and (ii) the possibility of recognizing simultaneous stable unions. It is important to highlight that these topics are of paramount importance not only for solving the case in question, but also for giving greater legal certainty to the various family conjectures that find themselves in these same situations, evidencing the unquestionable need to approach the topic so that the omissions and discrepancies are overcome. However, it is important to emphasize that this analysis is not intended to exhaust the subject, but rather to highlight questions and bring notes that are relevant for a better understanding of the institutes and contemporary challenges that are imposed on Law in the face of new family and succession phenomena. To this end, bibliographic and documentary research was used as a methodology, through legislative, doctrinal and jurisprudential study. As well as a case study, which consists of an in-depth investigation considering the context and peculiarities of the analyzed case. After thorough research, this article concluded that despite the evident inclination of the study courts and the doctrine for the inclusion of the partner as a necessary heir, based on the argument of unconstitutionality of the distinction of treatment between the family nuclei, the position of the Federal Supreme Court (“STF”) remains silent. The possibility of recognizing simultaneous stable unions, in turn, was declared unconstitutional by the STF. Therefore, in conflicts between coexisting families, recognition of the legitimacy of one nucleus over the other is inevitable, for the purposes of extension and applicability of state protection.
