Abstract
O presente trabalho tem o condão de analisar as mudanças e a repercussão que o acesso à internet e sua imensa expansão vêm causando no mundo jurídico, principalmente no que tange às formas de execução, mais especificamente em relação aos crimes de estupro e estupro de vulnerável cometidos por intermédio da internet.
Iremos analisar os crimes que visam proteger a dignidade sexual da vítima, suas características principais e meios tradicionais de consumação para, então, examinarmos a efetiva existência e possibilidade de enquadramento do chamado estupro virtual, aquele que se consuma sem o contato físico entre autor e vítima, frente ao texto legal vigente.
Por fim, avaliaremos os casos reais já catalogados como estupro virtual no Brasil, seu conceito e entendimentos doutrinários que viabilizam sua adequação como um novo meio de consumação dos tipos penais já existentes, sem que haja necessidade de sua alteração ou criação de um novo crime, uma vez que o Direito precisa acompanhar os avanços da sociedade moderna.
The present work is able to analyze the changes and repercussions that internet access and its immense expansion have been causing in the legal world, especially with regard to forms of execution, more specifically in relation to rape and rape of the vulnerable committed through the Internet. We will go into the analysis of crimes that aim to protect the sexual dignity of the victim, its main characteristics and traditional ways of consummation, so we will be able to examine the effective existence and possibility of framing the so-called virtual rape, that is consummated without the physical contact between the author and victim, in the current legal text. Finally, we will rate the real cases already cataloged as virtual rape in Brazil, their concept and doctrinal understandings that enable their adequacy as just a new way of consummation of the existing criminal type, without needing to change or create a new crime, once the law needs to follow the progress of the modern society.
