Esta monografia busca analisar a Reforma Trabalhista sancionada recentemente no
Brasil. Para isso, o estudo pretende traçar o histórico do trabalho da mulher e do direito
brasileiro, fazendo uma análise da situação pré-Reforma Trabalhista de 2017, que
alterou significativamente as normas de saúde da mulher, bem como, da Lei nº
13.467/2017, em relação aos seus impactos sobre o aspecto dos elementos principais
da relação de emprego e sobre a organização sindical. Isto porque, se considera que
a Reforma amplia a liberdade dos empregadores em determinar as condições de
contratação, o uso da força de trabalho e a remuneração dos trabalhadores, ou seja,
aquela busca imputar o processo de definição das regras da relação de emprego às
empresas, restringindo a participação das organizações dos trabalhadores e do
Estado. De maneira geral, esse processo já acarreta, primeiramente, o aumento da
insegurança dos trabalhadores e a perda de direitos, assim como a diminuição da
proteção social, de modo que se procura analisar tais efeitos especialmente quanto
às mulheres. Visando atingir tais objetivos, se utiliza o método indutivo, analisando a
legislação, artigos publicados na internet, notícias jurídicas e fazendo referências às
decisões judiciais, além de se valer da aplicação do que foi coletado no campo teórico
e prático, balizando as normas protetivas da mulher no trabalho brasileiro.
This monograph seeks to analyze the Labor Reform recently sanctioned in Brazil. To this end, the study’s intention is to trace the history of women's work and Brazilian law, making an analysis of the 2017 pre-retirement labor situation, which significantly changed women's health standards, as well as from Law nº 13.467 / 2017, its impacts on the aspect of the main elements of the employment relationship and on the union organization. This is because, it is considered that the Reform extends the employers' freedom to determine hiring conditions, the use of the workforce and the workers' remuneration, meaning that seeks to imput the process of defining the rules of the employment relationship to companies, restricting the participation of workers' organizations and the State. In general, this process already causes, mainly, the increased insecurity of workers and the loss of rights, as well as the reduction of social protection, so the presented study looks to analyze such effects, especially for women. In order to achieve these objectives, the inductive method will be used, looking for achieving the results of the study, analyzing the legislation, articles published on the internet, legal news and making reference to judicial decisions, in addition to using the application in the theoretical and practical field, guiding protective standards of women in Brazilian work.
