O presente trabalho tem como tema a eutanásia e o direito a morte digna. Em que o objetivo é abordar a dignidade humana como um caminho para a regulamentação da prática da eutanásia assim conseguir adequá-la ao âmbito jurídico. A problemática desta pesquisa se encontra no fato de que, no Brasil, não há leis e artigos específicos sobre a eutanásia, tornando o tema nebuloso e cercado de dúvidas e receios. Visto que quando necessário o julgamento de algum caso, o sistema jurídico se apoia no artigo relativo a homicídio simples. Sabendo que eutanásia vai muito, além disso, o autor motivou-se a produzir essa pesquisa, utilizando fontes históricas, bibliográficas, depoimentos e estudos em diversas áreas, como sociológica, científica e jurídica. Obtendo assim resultados esclarecedores, pois a partir da análise histórica, pode-se dizer que a reprovação da eutanásia nada tem a ver com valores científicos, mas sim tem muito mais a ver com crenças e argumentos que colocam a vida acima de tudo, independente de sua qualidade e da vontade do próprio indivíduo. Logo o autor atingiu resultados importantes, pois concluiu que o mais correto seria levar mais em conta o lado humano do paciente, e a partir de uma regulamentação normativa da eutanásia torna-se possível a descriminalização da mesma, levando os enfermos, em estado incurável ou terminal, possam optar por uma morte digna e sem prorrogar seu sofrimento. Por fim, conclui-se que o atual Código Penal brasileiro encontra-se defasado quando o assunto é eutanásia, e necessita de uma urgente atenção para regulamentar o tema, tipificando corretamente no dispositivo legal, colocando em pauta a dignidade humana e o direito a morte digna.
The present work has as its theme euthanasia and the right to a dignified death. In which the objective is to approach human dignity as a way to regulate the practice of euthanasia, thus being able to adapt it to the legal scope. The problem of this research is found in the fact that, in Brazil, there are no specific laws and articles on euthanasia, making the topic cloudy and surrounded by doubts and fears. Since when the judgment of a case is necessary, the legal system relies on the article on simple homicide. Knowing that euthanasia goes a long way, moreover, the author was motivated to produce this research, using historical, bibliographic sources, testimonies and studies in several areas, such as sociological, scientific and legal. Thus obtaining clarifying results, because from the historical analysis, it can be said that the disapproval of euthanasia has nothing to do with scientific values, but rather has much more to do with beliefs and arguments that put life above everything, regardless of their quality and the individual's own will. Soon the author achieved important results, as he concluded that the most correct thing would be to take more into account the human side of the patient, and from a normative regulation of euthanasia it becomes possible to decriminalize it, taking the sick in an incurable or terminal, can opt for a dignified death and without extending their suffering. Finally, it is concluded that the current Brazilian Penal Code is outdated when the subject is euthanasia, and needs urgent attention to regulate the issue, correctly typing in the legal provision, placing human dignity and the right to death worthy.
