dc.description.abstractO presente artigo tem por objetivo a análise da Legislação Brasileira vigente a respeito do uso das células-tronco, do procedimento de Diagnóstico Genético Pré-implantacional (DGPI) e, especificamente, da situação dos “Saviour Siblings”. Intenta-se, também, identificar a historicidade do DGPI no contexto mundial e no Brasil, analisando, para tanto, os princípios da Bioética e do Biodireito concernentes às práticas citadas e explicitando as legislações de outros países e o tratamento dado ao DGPI e aos “Saviour Siblings”. Por último, será feita uma breve análise sobre a dignidade da pessoa humana no que diz respeito ao tema, abordando os limites da terapia gênica, as possibilidades de interpretação do DGPI na sociedade brasileira e problematizando os precedentes que podem ser abertos em caso de banalização do uso da engenharia genética. Como metodologia, foram utilizadas fontes bibliográficas, apoiadas, em sua maioria, em artigos científicos relativos ao tema e fontes legislativas. Pode-se concluir, através da pesquisa e análise realizadas, que a criação do bebê-medicamento não será uma afronta à dignidade deste desde que sejam atendidos certos pré-requisitos para o uso do DGPI nesse contexto. Logo, é imprescindível a criação de uma legislação em âmbito federal no País que verse especificamente sobre Reprodução Humana assistida, Fertilização in vitro, DGPI, “Saviour Siblings”, além de uma série de outras matérias ligadas ao campo bioético.pt_BR
dc.description.abstractThis article aims to analyze the Brazilian Legislation in force regarding the use of stem cells, the Pre-implantation Genetic Diagnosis (DGPI) procedure and, specifically, the situation of the “Savior Siblings”. It is also intended to identify the historicity of the DGPI in Brazil and in the world context, analyzing, for this purpose, the principles of Bioethics and Biolaw concerning the practices mentioned and explaining the laws of other countries and the treatment given to the DGPI and the “Savior Siblings”. Finally, a brief analysis related to the theme will be made, discussing the dignity of the human being, addressing the limits of gene therapy, the possibilities of interpretation of the DGPI in Brazilian society and problematizing the precedents that can be set in the event of trivialization of the use of genetic engineering. As methodology, bibliographic sources were used, mostly supported by scientific articles related to the theme and legislative sources. It can be concluded, through the research and analysis carried out, that the creation of the Saviour Sibling will not be an affront to its dignity as long as certain prerequisites for using the DGPI in this context are fulfilled. Therefore, it is essential the creation of federal legislation level in the country with the purpose of dealing specifically with assisted human reproduction, in vitro fertilization, PGD, Savior Siblings, in addition to a series of other matters related to the bioethical field.pt_BR
