Os casos de injúria homofóbica no tribunal de justiça de São Paulo: uma análise jurisprudencial

O Supremo Tribunal Federal criminalizou a homotransfobia em 2019, considerando a como espécie do gênero racismo, e equiparando seus preceitos primários à Lei nº 7.716/89.
Destarte, surgiu um novo debate jurídico acerca da possibilidade de criminalização das ofensas
de cunho homofóbico, visto que o crime de injúria racial não constava na mencionada lei, mas
sim no art. 140, §3º, do Código Penal. Tal debate foi sanado em 2023, com a promulgação da
Lei nº 14.532/23 e a decisão acerca dos Embargos de Declaração opostos contra Acórdão do
Mandado de Injunção nº 4.733, os quais possibilitaram a criminalização das ofensas dirigidas
à orientação sexual e ao gênero como injúria racial, aqui denominada injúria homofóbica. Desta
forma, o presente trabalho possui como objetivo geral realizar uma análise dos Acórdãos do
Tribunal de Justiça de São Paulo, utilizando-se da metodologia de análise de discurso, a fim de
averiguar o teor das novas decisões exaradas pelos magistrados a partir de 2023. Como
objetivos específicos, busca-se (i) identificar a evolução do conceito de homofobia, (ii)
discorrer sobre os desafios encontrados pela população LGBTI+ para assegurar a garantia e
efetivação de direitos básicos, com ênfase especial para a necessidade ou não de tutela penal
por meio da criminalização das ofensas que decorrem de expressões de gênero e sexualidade.
The Supreme Federal Court criminalized homotransphobia in 2019, considering it one of the many manifestations of racism and equating its primary precepts through Law nº 7.716/89. Thereby, a new legal debate arose regarding the possibility of criminalizing homophobic offenses, since the crime of racial insult was not included in the mentioned law, but rather in Article 140, §3, of the Penal Code. This debate came to an end in 2023 through the enactment of Law nº 14.532/23 and the Decision on the Clarification Appeals filed against Judgment of Writ of Mandamus nº. 4.733, which enabled the criminalization of offenses directed at sexual orientation and gender as racial insult, here referred to as homophobic insult. Therefore, the present work aims to conduct an analysis of the Judgments of the Court of Justice of São Paulo, using the methodology of discourse analysis, in order to examine the content of 2 the new decisions issued by the judges from 2023 onwards. As specific objectives, it seeks to (i) identify the evolution of the concept of homophobia, (ii) discuss the challenges faced by the LGBTI+ population in ensuring the guarantee and enforcement of basic rights, with special emphasis on the need or not for legal protection through the criminalization of offenses arising from expressions of gender and sexuality.
