O objetivo deste artigo, longe de exaurir o tema, é expandir a reflexão
sobre a necessidade de adequação do Judiciário às novas tecnologias e à
inteligência artificial, com o intuito de promover a justa apreciação dos litígios num
menor tempo, sem, contudo, afastar-se das garantias fundamentais constitucionais,
notadamente da motivação das decisões judiciais, sob o prisma de alguns outros
princípios norteadores da Constituição Federal Brasileira, quais sejam: acesso à
Justiça, contraditório participativo, duração razoável do processo e publicidade,
possibilitando o controle e fiscalização tanto das partes envolvidas na lide, bem
como da população em geral. Através de uma visão panorâmica sobre os
mecanismos dos algoritmos, chegar-se-á à conclusão que, embora ainda não possa
ser atribuída a incumbência das decisões judiciais exclusivamente às máquinas, a
intensificação da implementação da inteligência artificial ao aparelho judicial é
necessária, e faz-se urgente para a efetiva aplicação do direito diante da alta
demanda de processos que encontram-se pendentes de julgamento no aparelho
judiciário.
The objective of this article, far from overtire the theme, is to expand the reflection on the need to adapt the Judiciary to new technologies and artificial intelligence, in order to promote the fair assessment of litigation in a shorter time, without, however, depart from fundamental constitutional guarantees, notably the motivation of judicial decisions, under the perspective of some other guiding principles of the Brazilian Federal Constitution, namely: access to Justice, participatory justice, reasonable duration of the process and publicity, enabling control and inspection both from the parties involved in the dispute, as well as from the general population. Through a panoramic view of the mechanisms of the algorithms, it will be concluded that, although it is not yet possible to attribute the judicial decisions to machines alone, the intensification of the implementation of artificial intelligence to the judicial apparatus is necessary, and makes there is an urgent need for the effective application of the law in view of the high demand for lawsuits that are pending judgment in the judiciary.
