Posicionamentos do Tribunal de Justiça paulista em ações ajuizadas por candidatos eliminados na fase de investigação social do concurso da polícia militar

Os editais que regem os concursos públicos da Polícia Militar do Estado de São Paulo
preveem uma fase de investigação social em que é averiguado, dentre outros tópicos, se o
candidato é “pessoa que mantenha relação de amizade, convivência ou conivência com
indivíduos envolvidos em práticas delituosas”, “possuidor de postura e/ou comportamento
que atentem contra a moral e os bons costumes”, “possuidor de registro policial nas condições
de averiguado, autor ou indiciado, desabonador à conduta ilibada, à reputação e à idoneidade
moral” ou “frequentador de local incompatível com o decoro”. Esta pesquisa buscou
compreender como as Câmaras de Direito Privado do Tribunal de Justiça do Estado de São
Paulo se posicionam diante das demandas movidas por candidatos que consideraram injusta a
eliminação do certame da Polícia Militar nesta fase. Foram analisados um total de 284
acórdãos prolatados pelo tribunal paulista ao longo de todo o ano de 2019. O trabalho conclui
que algumas Câmaras aparentam ser mais pró-Estado, enquanto outras tendem a concordar
mais com os argumentos dos candidatos recorrentes. Além disso, pelo volume de processos e
de decisões contrárias ao Estado, resta claro que a Polícia Militar paulista deve revisar o
critério de seleção na fase de investigação social de maneira a respeitar direitos fundamentais.
The public notice of selective exam of the Military Police of the State of São Paulo has a phase of social investigation in which it is verified, among other topics, if the candidate “is a person who maintains a relationship of friendship, coexistence or collusion with individuals involved in criminal practices”, “possesses a posture and/or behavior that violates morals”,“possesses a police record under the conditions of investigated, author or indicted” or “is a frequenter of a place incompatible with decorum”. This research sought to understand how the Private Law Chambers of the São Paulo State Court of Justice position themselves against the demands brought by candidates who considered the elimination at the phase of social investigation of the Military Police selective exam unfair. A total of 284 judgments by the São Paulo court throughout 2019 were analyzed. The work concludes that some Chambers appear to be more pro-State, while others tend to agree more with the arguments of the recurring candidates. In addition, due to the great number of lawsuits and decisions against the State, it is evident that the São Paulo Military Police must review the selection criteria during the social investigation phase in order to respect fundamental rights.
